Study On Village Rules And Regulations Of Yunnan In Qing Dynasty

The procedures and operational systems of township regulations in Yunnan during the Qing Dynasty were generally consistent with those in the mainland.However,due to the unique geographical conditions and social and cultural environment of Yunnan,the content of the village rules and regulations was somewhat unique.In this paper,we use the surviving legal inscriptions in Yunnan as historical materials to explore the features and functions of the Qing dynasty Yunnan village regulations through the analysis of their contents.This study briefly explains the origin and significance of the topic by reviewing the state of domestic research in the field,and highlights the innovations in both the research perspective and the historical materials.The research is divided into four categories: social morale,social order,ecological environment,and other aspects.The content of the inscriptions is then analyzed according to their classification,and their overview,main features,and issues are examined in depth.The above analysis,combined with the background and regional characteristics of the time period,reveals three characteristics of the national,local,and autonomous nature of the Qing dynasty inscriptions in Yunnan.On this basis,we analyze the functions of the inscriptions in Yunnan’s grassroots social governance during the Qing Dynasty.The functions of the inscriptions were mainly to regulate social conflicts and to maintain the order of production and life of the villagers.At the social level,the village rules and regulations were an indispensable means to mediate the relationship between the villagers and resolve daily disputes,while at the same time,they were able to formulate agricultural production rules that reflected the wishes of the villagers and met their needs by means of public discussion,effectively maintaining the order of rural production and life.At the institutional level,the village rules and regulations are relevant and flexible,and can effectively compensate for the lack of national laws in the process of formulation and implementation.Based on the above systematic study,we analyze the legal significance and revelation of the traditional village rules and regulations,in order to discover what the inscriptions of village rules and regulations in Yunnan during the Qing Dynasty can be used for the construction of the rule of law in contemporary villages.
