In recent years,with the vigorous development of the Yangtze River shipping industry,there has been excess capacity of inland ships,and a large number of ship owners have generally lowered the freight rate for survival,which leads to vicious competition.Driven by the survival pressure and interests,inland ships have illegally engaged in sea transportation.However,according to the relevant requirements of China’s ship construction code,inland river ships sailing beyond the navigation area cannot adapt to the sea wind and waves,and it is very easy to cause a tragedy of ship destruction and death.On the other hand,the state attaches more and more importance to the protection of the Yangtze River and gradually tightens the sand mining license in the Yangtze River Basin,which directly leads to the increasing shortage of sand and stone resources.However,with the rapid development of the Yangtze River Delta,the demand for sand and stone for infrastructure projects is gradually expanding,and the imbalance between supply and demand of sand and stone leads to the rising price.Driven by the competitive pressure of shipping industry and the real profits,a large number of inland vessels in the Yangtze River have illegally engaged in maritime transportation,and caused many water traffic accidents.The public safety problem derived from the illegal transport of inland vessels has seriously threatened the stability of the water safety situation and the safety of people’s life and property in the Jiangsu section of the Yangtze River.On the basis of consulting a large number of domestic and foreign literature and combining with the author’s thinking in maritime law enforcement,this paper tries to solve the problems that maritime departments in Jiangsu section of the Yangtze River are faced with in the process of regulating illegal maritime transport by inland vessels.Based on the current situation of illegal maritime transport by inland vessels in Jiangsu section of the Yangtze River,it analyzes the difficult problems existing in law enforcement.And in-depth analysis of the causes of the problems.At the same time,the composition and characteristics of the maritime supervision system of the developed countries in Europe and the United States were reviewed,and the domestic maritime authorities in Hebei,Shanghai and Fujian were summarized and analyzed by comparative analysis method in the rectification of illegal traffic in inland rivers,absorbing the existing advanced management system and experience at home and abroad.Combined with the characteristics of the waters in Jiangsu section of the Yangtze River and the reality of maritime safety supervision by maritime authorities,this paper makes full use of the theory of safety management,the theory of multiple governance and the theory of service-oriented government,discusses from the aspects of legal system construction,law enforcement mode reform,publicity and guidance,and multiple governance,and puts forward opinions and suggestions on the treatment of illegal maritime transportation by inland vessels in Jiangsu section of the Yangtze River.So as to improve the efficiency of maritime law enforcement,completely curb the inland vessels’ maritime transport behavior,and effectively maintain the stability of the water traffic safety situation in Jiangsu section of the Yangtze River.
