Case Study Of Government Responsibility In The Disposal Of The Construction Of The World Ex Home In M City

As a peculiar phenomenon in China’s real estate industry,the suspended construction project(rotten tail building)refers to the inability of development enterprises to continue operations due to various reasons,the project construction has entered a long period of stagnation,and the pre-purchase agreement of the majority of pre-purchased owners unable to be fulfilled.A phenomenon that affects social stability.As a socialist country in China,the government has the responsibility to safeguard the vital interests of the majority of society,and therefore has the obligation to promote the construction of the delayed construction project.This thesis takes M City Ex Homestead Construction Project as an example.It studies the actions taken by government departments in advancing the project construction,analyzes from three aspects:administrative legislative responsibility,administrative execution responsibility,and administrative supervision responsibility.And through literature research,field investigation,interview method and other research methods,trying to clarify the responsibility problems of the two-level government in the urban area during the disposal process.The results of the study show that the government’s legislative problems in the process of disposing of the suspension and deceleration projects are as follows:First,there are no special laws and procedures for disposing of the suspension and deceleration projects;Second,the subordinate laws of the current law and supporting regulatory documents Lack of position;Third,the relevant laws for real estate development enterprises to withdraw from the market are not perfect.There is an unreasonable division of tasks in the performance of administrative responsibilities,there is blame and blame in the performance of government duties,and the scope of government intervention is too broad.In the aspect of administrative supervision,there is a lack of administrative supervision mechanism.This article believes that the reasons for these problems include policy roots and reality roots.In terms of policy roots:First,the petition system was abused,and the government did not legislate to deal with the need to stop construction projects;Second,the current real estate-related policies and regulations were not sound;Third,the authority and responsibility of the urban government were inconsistent;Fourth,the management scope of the government’s intervention in the suspension and deceleration project has not been set.In terms of realistic root causes:First,there are evading responsibilities by government departments;Second,it is extremely difficult to deal with the suspension of construction projects;Third,there is a lack of experience for the suspension of construction projects.Therefore,the countermeasures proposed in this article are as follows:In terms of administrative legislation,it is recommended to establish laws and regulations to clarify the basis for the government to dispose of suspension and decommissioning projects;In terms of administrative execution responsibilities,it is recommended to perfect the current policies and regulations,and to strengthen the current laws and regulations related to the disposition of suspension and demolition projects Maneuverability,clearly define the government responsibilities in the disposition of suspension and deceleration projects,in terms of administrative supervision,it is proposed to strengthen the administrative supervision responsibilities in the disposition of suspension and demolition projects.
