At this stage,my country already has an environmental liability insurance system,and it is in the process of active trials.However,it is not difficult to find that the current environmental liability insurance pays too much attention to environmental infringements caused by industrial production activities,and often ignores the environmental problems caused by agricultural production activities.The reality is that the prevention and control of agricultural pollution in my country is imminent,and a new response is urgently needed.Agricultural environmental liability insurance,as a socialized relief method that adopts comprehensive economic,legal,technical and other means,can effectively deal with environmental pollution problems caused by agricultural activities.From this,the academic community has begun to explore the role of agricultural environmental liability insurance in solving specific agricultural pollution.possibility.The scope of agricultural environmental liability insurance is related to important issues such as whether agricultural environmental liability insurance can be accepted by the market as a new type of insurance and whether it can achieve effective underwriting.This thesis will be based on traditional insurance theory and jurisprudence,divided into the following four chapters to elaborate on the theoretical and practical issues of the scope of agricultural environmental liability insurance.In the introduction part,the thesis systematically introduces the research methods and innovations;in the main text part,it first discusses the theoretical proof of the agricultural environmental liability insurance coverage,including the definition of the connotation of the coverage and the influence of the traditional insurance law theory on the coverage.In the influence of traditional insurance theory on the scope of insurance,it discusses in detail the insurability of risks,the analysis of the insurability of agricultural environmental risks,and the limitations of the attributes of liability insurance on the scope of insurance.Then a systematic introduction to the expansion of agricultural environmental liability insurance and theoretical sources,starting with the theoretical basis of tort liability and contract liability,and discussing the liability for intentional acts;again,on the basis of theoretical justification for the scope of insurance,from my country Starting from the existing legal basis of the insurance contract,as well as the underwriting enthusiasm and economic cost of both parties in the insurance contract,we will discuss in detail the "restrictions on the contract".From the above discussion,it can be concluded that if my country wants to practice agricultural environmental liability insurance at this stage,its coverage is the sudden agricultural environmental tort liability,the liability for own site governance,the liability for ecological environmental damage and the compensation for mental damage,etc.;the final focus is Discuss measures to improve the scope of insurance coverage,and explore the feasibility of the scope of agricultural environmental liability insurance in practice through the establishment of legal basis,construction of supporting systems,selection of insurance models,selection of underwriting institutions,and insurance market cultivation.
