Research On The Law System Of Environmental Liability Insurance In China

Environmental liability insurance is a new type of insurance industry,is an important way to protect environment basic national policy implementation in China,to ease the crisis of environmental pollution in China,to a certain extent,to ensure that victims receive timely compensation.in recent years,although our government attach great importance to environmental liability insurance,expanding the scope of the pilot,but in the course of the trial did not achieve the desired results,there are still some problems,leading to the slow development of environmental liability insurance in China,and even remain stagnant.Therefore,our country should continuously perfect the legal system of environmental liability insurance,for the development of environmental liability insurance to provide a good environment.In this paper,the study of legal system of environmental liability insurance,including the following aspects: first of all,introduced the related environmental liability insurance legal system of the environment right theory,the theory of environmental tort liability,liability insurance theory and the theory of corporate social responsibility and the relationship between the theory and the environmental liability insurance is analyzed,which lays the theoretical basis for the study of environmental liability insurance legal system.Secondly,introduces in detail the specific content of the environmental liability insurance: insurance coverage,insurance premium,insurance mode and the main body,which is the premise of the environmental liability insurance system.insurance and insurance,which is the premise of the environmental liability insurance system.Again,in-depth analysis of the current situation of environmental liability insurance in our country,summarizes the legal basis,policy basis and practical basis,discusses the existing problems and its reasons.Finally,comparison and reference to foreign mature about the environmental liability insurance experience,aimed at the problems existing in the legal system of environmental liability insurance in our country,through establish and perfect the relevant laws and regulations,specific content,correctly handle the relationship between the government,enterprises and institutions of the three insurance and improve the supporting measures to improve the legal system of environmental liability insurance in our country,the environmental liability insurance can be in a good environment for the healthy and orderly development.I hope these suggestions can do some contribution to the environmental liability insurance in China.
