Research On The Allocation Of Environmentaladministrative Law Enforcement Powers Under The Background Of Vertical Management Of Environmental Protection Institutions

The current reform of ecological environment law enforcement system is essentially the adjustment of the allocation of ecological environment administrative law enforcement power.The purpose is to make the administrative power and financial power of the ecological environment law enforcement department get a good allocation after the reform.Whether the reform can be well implemented and implemented,it is ultimately necessary to implement it in the process of law enforcement practice.Therefore,the current reform of ecological environment law enforcement is selected as the research object,and the allocation of ecological environment law enforcement power is studied in combination with the provisions and requirements of laws,regulations and reform policies on the allocation of law enforcement power.Studying and solving these problems is conducive to improving the efficiency of ecological environment law enforcement and has important practical significance for ensuring the effectiveness of ecological environment law enforcement system reform.Therefore,this paper is divided into four parts.The first part introduces the theoretical concepts of law enforcement power allocation and ecological environment law enforcement power.The second part mainly analyzes the current legislation,policy requirements and actual situation of ecological environment law enforcement.The third part summarizes the dilemma of ecological environment law enforcement allocation in the county,such as the imperfect allocation of ecological environment law enforcement power,the unclear subject and authority of ecological environment comprehensive law enforcement,and the sinking of ecological environment law enforcement power to the imperfect mechanism of township(street).The fourth part follows the principle of rule of law,the principle of integrity,and the principle of efficiency.From the aspects of giving county-level ecological environment sub-bureau independent law enforcement power,strengthening the coordination of county-level ecological environment law enforcement power,clarifying the main positioning and terms of reference of comprehensive ecological environment law enforcement,and improving the sinking mechanism of ecological environment law enforcement power,it proposes to optimize the allocation of ecological environment law enforcement power.The full text is carried out within the above framework,hoping to optimize the outline of the allocation of ecological environment law enforcement power in China.
