Research On The Legal System Of Environmental Pollution Compulsory Liability Insurance In Our Country

Since our country’s reform and opening up,the industrialization process has accelerated,and the evolution of ecological environment and environmental pollution accidents have increased.Since the environmental pollution liability insurance system can safeguard the legitimate rights and interests of the incident,reduce the economic burden of the enterprise and promote the transformation of government functions,this liability insurance system has gradually emphasized and developed.Environmental pollution liability insurance systems with environmental and insurance double features gradually appear in the Volkswagen Vision.In 1991,my country’s individual provinces and cities began trial pilot implementation of environmental pollution liability insurance systems,which has been accumulated in the past 30 years.However,according to the current legislative status of the legal system of "Environmental pollution compulsory liability insurance" in my country,the legal system of "Environmental pollution compulsory liability insurance" in my country is not mature,and relevant laws and regulations and supporting mechanisms need to continue to be improved.Therefore,it is necessary to find out the development of this liability insurance system on the basis of the overall analysis legislation and implementation status.At the same time,the experience of studying the relevant legal systems in the country can put forward the recommendations of the "Environmental pollution compulsory liability insurance" legal system in my country,thus effectively promoting the development of the development implementation process.Through the analysis of environmental pollution enforcement liability insurance,the "Environmental pollution compulsory liability insurance" system is summarized in practice in practice.The development of this liability insurance system in China is divided into three stages,and the legislative status is analyzed from the two legislative levels in each phase,and the current status of the pilot implementation of the insurance is analyzed.Through the above analysis,the problems in my country’s liability insurance system are summarized.In response to the problems,comparative analysis is adopted to introduce the laws and system of the environmental pollution liability insurance in Germany,and propose a development idea for the legal system of this insurance system.Finally,the study conclusions are proposed: in the selection of the legislative path of this liability system,"Environmental Protection Law" should be clearly stated in the "Mandatory",and the "Environmental Pollution Mandatory Liability Insurance Implementation Regulations should be established." In the relevant laws and regulations,the provisions on the content of "Environmental pollution compulsory liability insurance" are supplemented;in the "Regulations",the core content of "Environmental pollution compulsory liability insurance" is set up,set up a special policy underwriting entity,expand the scope of insurance,and increase claims;For the supporting mechanism of "Environmental pollution compulsory liability insurance" implementation,it is recommended to establish and improve the environmental pollution enforcement liability insurance risk assessment system,and the government should implement excitation and supervision of "Environmental pollution compulsory liability insurance".
