Research Of The Cross Border Cooperation Legal Mechanism Between River Leaders In The Yellow River Basin

For a long time,the Yellow River basin water environment governance has been faced with the dilemma of "segmentation".Protecting the ecological environment of the river basin and achieving high-quality and sustainable development of the river basin are not only the needs of ecological civilization of the Yellow River basin as an important ecological barrier and water conservation area in China,but also the needs of economic and social civilization to form a fully balanced development situation.By sorting out the legal system and practice status of cross-border cooperation in the Yellow River basin,it is found that the legal mechanism of cross-border cooperation in the Yellow River basin is not sound in terms of cross provincial,cross sectoral,multi subject co governance,information sharing and other dimensions under the background of the river leader system.Among them,the authority and capacity of river basin management agencies to coordinate cross-border water issues are insufficient,the responsibility system of provincial river governors for cross-border cooperation is not perfect,the role of provincial horizontal cross-border administrative agreements is insufficient,the legal basis for the division of powers between river governors and relevant departments is lacking,the joint law enforcement mechanism between river governors and departments is not perfect,and the legal guarantee for multi subject co governance is insufficient The imperfect legal mechanism of river length information sharing in the basin is the important reason for these problemsTo coordinate watershed management,it is necessary to reconcile the contradiction between the overall watershed management and the segmented management of administrative regions,break down barriers between departments,integrate the collaboration of various governance bodies,and improve the level of information sharing.By analyzing the legal experience of cross-border co governance at home and abroad and summing up the enlightenment,from the perspective of "vertical cooperation","horizontal cooperation","judicial cooperation","cadre mass cooperation" and other perspectives,we will find the way to optimize the legal mechanism of cross-border cooperation in the Yellow River basin with the "river leader system" as the main line,solve the dilemma of "segmentation" of the Yellow River basin governance,and help the Yellow River basin comprehensive and integrated governance under the background of the river leader system.
