| The ecological protection and high-quality development of the Yellow River Basin has become a major national strategy.General Secretary Xi Jinping pointed out that ‘in the governance of the Yellow River,we should focus on protection and governance’.At the same time,He called for ‘coordinated promotion of large-scale governance’ and the exploration of high-quality development of strategic ideas.In October 2021,The Yellow River Protection Law(draft)was deliberated and adopted at the Executive meeting of The State Council,and submitted it to the Standing Committee of the National People’s Congress for deliberation in December,which is the second river basin legislation in China after the Yangtze River Protection Law.The improvement of the ecological environment of the Yellow River is related to hundreds of millions of people,has an important ecological development strategy position.In recent years,with the increase of intensity and breadth of ecological governance in the Yellow River Basin,the results of governance are remarkable,but in the unbalanced and uncoordinated situation of regional economic growth and environmental ecological protection,exploring cross-regional collaborative governance has become the key to the future governance of the Yellow River Basin.The ecological governance of the Yellow River Basin aims to create a spatial layout of "one belt,five districts and multiple points" for ecological protection in the Yellow River Basin,while Shaanxi is located in the middle reaches of the Yellow River and the hinterland of the Loess Plateau,which is an important link in the ecological governance of the Yellow River Basin.The Loess Plateau in the north of Shaanxi Province is an important ecological belt along the Yellow River and a key area for the prevention and control of soil erosion;the Wei River in central Shaanxi Province,as the main tributary of the Yellow River,is an important area for water pollution prevention and control,as well as an important part of the Yellow River delta wetland ecological protection zone;the Qinling Mountains in southern Shaanxi are the key ecological function areas of the water conservation area.The complexity and diversity of ecological governance in the Shaanxi section of the Yellow River Basin make it necessary to consider formulating regional governance measures according to regional governance priorities in the governance process,and at the same time connect with other regions to form the effectiveness of collaborative governance.This paper analyzes the legal system of ecological governance in the Shaanxi section of the Yellow River Basin from the perspective of collaborative governance.The introduction section explains the research background and significance,and clarifies the importance of ecological governance in the Shaanxi section of the Yellow River Basin under the background of collaborative governance.Based on the collaborative perspective,the second part sorts out the ecological governance of the Shaanxi section of the Yellow River Basin,and summarizes the legal system of ecological governance in the Shaanxi section of the Yellow River Basin in combination with the ecological status quo of the Shaanxi section;the third part analyzes and summarizes the current situation of the legal system of ecological governance in the Shaanxi section from the three perspectives of governance subjects,governance content and governance measures;the fourth part is to summarize the difficulties in the ecological governance process of the Shaanxi section in terms of governance subjects,governance content and governance measures;the fifth part analyzes the experience of watershed governance at home and abroad,and summarizes the experience of collaborative governance in other sections of the Yellow River Basin and the main ecological governance process of the Yangtze River Basin,and learn from foreign experience in watershed governance,in order to provide valuable experience for the ecological governance of the Shaanxi section of the Yellow River Basin;the sixth part is to analyze the existing problems in the ecological governance of the Shaanxi section,and seek the improvement path of the governance subjects of ecological governance in the Shaanxi section of the Yellow River Basin,the rich measures of the governance content and the implementation methods of the governance measures,from the legislative,judicial,law enforcement conducts a perfect path analysis from multiple angles,strives to achieve the development goals of regional linkage,complementary advantages,and mutual benefit and win-win results,and finally effectively promotes and implements the ecological protection and high-quality development of the Yellow River Basin. |
