Research On The Legal Issues Of Marine Plastic Waste Management In China

Marine plastic pollution is affected by the overall mobility of the ocean,the pollution of the marine environment is continuous and diffuse,plastic itself is not a pollutant,marine plastic pollution is essentially the mismanagement of land-based sources of plastic waste to the marine environment leakage.China as a large plastic production and consumption countries,plastic pollution brought about by the environmental pollution problems can not be ignored.In the management of plastic waste,China has established a large scale recycling system,and some coastal areas have also carried out local legislation on plastic waste management.Although China’s plastic waste management system has been initially built,but in the prevention and control of microplastics,waste classification and recycling,responsibility for the main body of the legal system there are still some problems to be solved.Under the background requirement of "14th Five-Year Plan" plastic pollution control action plan to further improve the plastic pollution control system,this paper focuses on the legal problems of plastic waste control in coastal areas,and how to solve the legal problems in the process of plastic pollution control is an important task to deal with the marine plastic waste control.The first chapter is an overview of marine plastic garbage management.Firstly,it introduces the characteristics and hazards of marine plastic garbage,summarizes the sources and pollution status of marine plastic garbage,and understands the necessity of managing marine plastic pollution.Secondly,the local regulations of the country and coastal cities are sorted out to provide support for the research questions of the article.The second chapter is to analyze the current situation and legal problems of marine plastic garbage management in China.By sorting out the practical experience of plastic waste classification and recycling and local regulations of coastal cities,the current situation of plastic waste governance in coastal areas is summarized,and further legal problems such as the incomplete law of plastic pollution prevention and control,the lack of legal regulation of microplastic pollution,the lack of unified standards of waste classification system,and the imperfect responsibility of plastic waste governance subjects are found.The third chapter is an examination of the legal regulation of marine plastic waste in foreign countries.By analyzing the experience of the United States,Japan,Germany and other countries in the management of marine plastic garbage,the legal system of each country in the management of plastic garbage is sorted out,and the characteristics of each country’s system in plastic pollution special legislation,perfect garbage classification,strict accountability,and mandatory deposit recovery are summarized to provide a reference path for China to deal with the legal problems of marine plastic garbage management.The fourth chapter is to suggest the legal improvement of marine plastic garbage management in China.In response to the legal issues raised in the previous section,we propose to promote special legislation on plastic pollution prevention and improve the garbage classification system;for new pollutants such as marine microplastics,we propose to supplement the emission standards and strengthen the legal regulation of products containing microplastics;for the end management of marine plastic garbage pollution,we propose to standardize the unified standards of domestic garbage classification and the environmental impact assessment standards of degradable plastics.For the problem of accountability of all parties,we can strengthen administrative supervision,clarify the mandatory recycling obligations of enterprises,and strengthen the accountability of individuals to implement the responsibility of all parties,and consolidate the legal guarantee of the system of marine plastic management.
