Research On The Related Subjects Of China’s Ecological Compensation System

In China,where the economy has made significant progress in the new era,ecological issues have gradually become an important factor affecting China’s high-quality development.In such a social situation,the ecological compensation system,as a systematic project to protect the ecological environment,has been proposed and applied in practice.Its design purpose is to achieve ecological balance and sustainable development of the environment.Faced with the objective national conditions of China’s vast territory,it is undeniable that the government,as the administrative entity,has unparalleled advantages in leading the operation of the ecological compensation system in other markets and social entities,including in various aspects such as fund preparation,institutional implementation,and compensation efficiency.However,it should also be noted that under the decisive mechanism of the market,the ecological compensation system led by the government is gradually unable to meet the social needs of ecological compensation practices,resulting in the problem of a single compensation subject and unclear compensation subjects.This further leads to issues such as narrow sources of compensation funds and unreasonable compensation standards,which hinder the comprehensive implementation of ecological compensation.To address the above issues,the report of the 19th National Congress of the Communist Party of China proposed the establishment of a market-oriented and diversified ecological compensation system,pointing out the direction of development for supplementing and expanding the relevant entities of China’s ecological compensation system.The report of the 20th National Congress once again reiterated the need to "establish a mechanism for realizing the value of ecological products and improve the ecological protection compensation system,Building a market-oriented ecological compensation legal system in China’s national conditions is not based on abandoning the government as the main behavior,but should fully leverage the government’s regulatory guidance function in the future to achieve a diversified ecological compensation legal system that combines the two.However,due to the insufficient practice in China,the clear subject of achieving diversification and precision must be guided by relevant theories in order to proceed smoothly.This article uses various analytical methods,including literature analysis,comparative analysis,and case analysis,to summarize and summarize the legal issues of the relevant subject in the ecological compensation system,analyze the current development status,and propose further improvement suggestions,providing possible specific types for expanding the subject of the market-oriented ecological compensation system.Firstly,the subject practice,legal concepts,theoretical basis,and differences from other environmental legal systems of the ecological compensation system were explained,and the binary subject division of the ecological compensation system was defined,pointing out the direction for the next step of research.At the same time,the legislative status of relevant subjects was organized;Secondly,analyze and study the current institutional practice in China,mainly seeking the problems of relatively single compensation subjects and unclear compensation subjects.In response to this,draw on the relevant regulations of foreign institutional subjects,and provide a certain idea for improving the construction of relevant subjects in China;Finally,from the perspectives of strict government responsibility,establishment of"ecological banks",reference to"ecological labels"and confirmation of direct beneficiaries,classification and definition of the role of the government in ecological compensation,that is,whether the government is a "representative"or "agent",and incentives for special contribution organizations,suggestions are proposed to provide support for the construction of market-oriented and diversified related entities in China.
