Study On The Implementation Of Soil Pollution Risk Control System In China

Soil pollution not only destroys ecological environment balance,but also threatens human health and living safety.Soil pollution risk control and remediation are directly related to human life and health as well as the sustainable development of economy and society.The implementation of the Law on the Prevention and Control of Soil Pollution has made the soil pollution prevention and control work in China step into the track of rule by law.As an important system,soil pollution risk control is an important guarantee to regulate soil pollution prevention and control.However,there are still some problems to be solved in the implementation of soil pollution risk control system.In order to effectively solve the problem,it is necessary to clarify the legal connotation of soil pollution,the legal basis of soil pollution risk control,the meaning of soil pollution risk control system,and its constituent system.And mainly from the perspective of agricultural land and construction land,explore the risk control principles,risk control standards,risk control and remediation rules and other policy measures and institutional arrangements for the prevention and control of soil pollution.Through the relevant legislative practice and the exploration experience of the six pilot zones for comprehensive prevention and control of soil pollution,local governments have gradually improved local standards for risk control,reasonably refined risk control procedures,and strengthened risk control by classification and linkage,achieving a certain degree of success in the prevention and control of soil pollution.However,there are still some practical difficulties,such as the existing standards are difficult to fully implement the system objectives,the confusion in the process of program implementation,and the supervision of the whole process has not been fully realized.This is mainly due to the influence of internal factors such as the incomplete ecological risk control standard,the overall low qualification threshold,and the obvious interference of economic factors in the whole process of supervision.Therefore,the ecological risk control standard system should be improved by strengthening the study of soil pollutant toxicity and ecological risk soil environmental benchmark;the mechanism of soil pollution risk review and supervision should be improved by standardizing assessment activities,perfecting expert database of soil pollution prevention and control,and publicizing assessment information;the public participation procedures should be introduced to support the realization of whole-process supervision efficiency by clarifying participation procedures in soil environmental decision-making,standard formulation,soil pollution investigation,risk assessment and risk control,strengthening risk communication and exchange,and timely disclosing information.In this way,the function of soil pollution risk control system can be ensured,the soil pollution prevention and control work can be regulated in an orderly way,and the battle of pure land protection can be fought in accordance with the law.
