| China’s new Soil Pollution Prevention Law issued in 2019 makes up for the gap of special laws on soil environmental protection in China,but there are still many deficiencies,how to effectively protect the soil environment has become a major problem at present.This paper simply explores the prevention and control system of soil pollution in China from the perspective of the rule of law,analyzes the related problems existing in the prevention and control of soil pollution,and then gives suggestions for the prevention and control of agricultural soil pollution in China.The main body of this paper is mainly composed of four parts.The first part is an overview of the general situation of agricultural soil pollution in our country,in which the causes and characteristics of agricultural soil pollution in our country are analyzed and summarized.The author divides it into local factors and exogenous factors for analysis.Different types of pollution factors lead to different pollution responsibility subjects,and the soil pollution problems caused by them are also different,thus leading to the second part of this paper.That is,the problems existing in the prevention and control of agricultural soil pollution in our country are mainly analyzed from the aspects of legal legislation,judicial enforcement and law-abiding consciousness.Each different level also reflects the existing problems of the pollution responsible subjects from the side.The third part is the experience of foreign soil pollution prevention and control legislation,which mainly analyzes the characteristics and important prevention and control measures of the soil pollution prevention and control experience in the United States,South Korea,Japan and Germany,and carries out comparative research according to our own situation to obtain relevant reference and management experience.The fourth part is the suggestions to improve the prevention and control of agricultural soil pollution in our country.This part mainly combines the above-mentioned soil pollution prevention and control problems with the practices of relevant local governments,and draws lessons from foreign soil pollution prevention and control experiences to propose solutions,such as establishing strict liability identification methods,establishing ecological compensation mechanism to construct a soil pollution prevention and control mechanism combining rewards and punishments,etc. |
