The issue of biodiversity conservation is the most concerned environmental issue in the world.Agricultural biodiversity is the foundation of agriculture,one of the core issues of the Convention on Biological Diversity,and is of great practical significance to world food security and sustainable agricultural development.China’s agricultural biodiversity is facing a serious situation.Although China has enacted laws and regulations related to the conservation of agricultural biodiversity,it lacks a basic law with biodiversity conservation as its core,and the legal documents directly targeting agricultural biodiversity are mainly regulations and normative documents of government departments,which are of low validity and have complicated and scattered contents,and are far from truly effective protection of agricultural biodiversity.In general,there is still much room for improvement in China’s agricultural biodiversity protection legislation.This paper examines the current laws and regulations relating to the conservation of agricultural biodiversity in China.In the first chapter,we analyse the connotation of biodiversity,summarise the levels of expression and the difficulties faced by agricultural biodiversity,sort out the existing legal provisions on agricultural biodiversity conservation in China,and summarise the characteristics of China’s complicated and scattered legislation from a vertical perspective.Chapter 2 examines the existing problems of agrobiodiversity conservation in China,with four main challenges: unclear design concepts of agrobiodiversity legislation,immature assessment and monitoring systems,inadequate ecological compensation systems,and imperfect systems for the prevention and control of alien species.Chapter 3,framing the legislative principles of agricultural biodiversity conservation,mainly including following the concept of ecological civilization and building up the legislative principles guided by the principles of systemic holistic conservation,in situ habitat conservation and use for conservation,will play an important role in China’s environmental protection and escort agricultural biodiversity conservation.In the fourth chapter,based on the analysis of the existing problems and causes of agrobiodiversity in China as described in the previous sections,legislative proposals to accelerate the improvement of some legal systems are proposed in the light of China’s specific national conditions,so as to better protect agrobiodiversity in China.
