Research On The Legal System Of National Park Concessions

Conservation and development is a key concern in national park construction,which not only involves how to coordinate the relationship between various stakeholders in national parks,but also affects whether national parks can sustainably achieve the construction goal of "national ownership,shared by all,and passed down from generation to generation".In order to solve the conflict between national park protection and development,the national park concession system was born.With the continuous promotion of the national park system,each national park pilot area has made useful exploration and accumulated a lot of experience in local legislation and concession practice,but there are still some shortcomings in the national legislation and specific system construction.This paper uses literature research,empirical analysis and comparative research to conduct a systematic study on improving the legal system of national park concessions.Firstly,it clarifies the concept and characteristics of national park concessions,explains the main theoretical basis of national park concessions and the important functions of the legal system of national park concessions.Secondly,it examines the current situation of national park concessions legislation and practice,comparatively analyzes the management norms of national park concessions in Sanjiangyuan,Wuyishan,Pudacuo,Qilianshan,Qianjianggyuan,Giant Panda and Hainan rainforest,examines the practice of national park concessions,summarizes the typical experiences that can be replicated,and further analyzes the main problems in national park concessions.Again,the typical experiences of national park concessions in the United States,Australia,Japan and South Africa are compared and analyzed.Finally,based on the comprehensive consideration of China’s national park construction goals and the needs of national park concessioning practice,and drawing on the successful experience of national park concessioning in foreign countries,we propose suggestions to improve the legal system of national park concessioning in China and promote the construction of major systems in response to the existing problems,including the introduction of the National Park Law,the formulation of the Regulations on National Park Concessioning,the improvement of local national park concessioning The proposals include the introduction of the National Park Law,the formulation of the Regulations on National Park Concessions,the improvement of the management methods of local national park concessions,the establishment of concession access,supervision,environmental assessment system and revenue distribution mechanism,the establishment of the participation mechanism of indigenous residents,and the improvement of the liability system,etc.,in order to provide some useful references for the improvement of the legal system of national park concessions in China.
