Research On The Judicial Appraisal System Of Ecological Environment Damage In China

In recent years,with the steady development of China’s society and economy,environmental pollution and ecological damage have attracted widespread attention.Environmental pollution not only affects the public’s physical and mental health and property security,but also relates to the ecological role of environmental resources themselves.Ecological damage forensic system can effectively define the level of environmental pollution,ecological damage caused by the natural environment,the logical relationship,the main body of responsibility,can further clarify the environmental management and ecological management costs,damage compensation costs.This is also a crucial technical basis and evidence support in environmental litigation activities.At present,China’s ecological damage forensic system of research and practice is still in its infancy,has not yet established a sound legal system,funding system,working mechanism and supervision system,ecological damage forensic institutions also exist in the number and lack of talent reserves.To this end,strengthening the study of the basic theory and practice of the ecological and environmental damage forensic identification system is an important countermeasure and powerful means to further improve the quality of environmental resources litigation cases and better solve the ecological and environmental damage problems in China.The main part of the thesis is divided into two major parts: the introduction shows the background and practical significance of the topic,briefly describes the current situation of the research on the judicial appraisal system of ecological and environmental damage at home and abroad,and clarifies the research method and innovation of the thesis.The main part firstly outlines the basic theory of ecological damage forensic system,analyzes its connotation,characteristics and significance.Secondly,it introduces the current situation of the judicial appraisal system of ecological and environmental damage in China and analyzes the shortcomings of the system.Once again,we introduce the natural environmental damage forensic system in the United States,Japan,Canada,Germany and other countries in terms of law,management and funding,and draw inspiration from the development experience of foreign countries to improve the ecological environmental damage forensic system in China.Finally,for the shortcomings of the judicial appraisal system of ecological and environmental damage in China at the present stage,we put forward clear suggestions for the improvement of the judicial appraisal system of ecological and environmental damage in China,taking into account the current situation of judicial practice in China and the relevant work experience of overseas countries.
