Research On Consultation And Supervision Mechanism Of Ecological Environmental Damage Compensation

Since the 18 th National Congress of the Communist Party of China,ecological environmental protection,as a systematic and arduous project,has an increasingly important strategic position in the national governance system.In the report of the Eighteenth National Congress of the Communist Party of China,the construction of ecological civilization appeared for the first time in the form of a single-chapter discussion,and was included in the overall layout of the "five in one" socialist cause with Chinese characteristics.Not only that,the report of the Nineteenth National Congress of the Communist Party of China called for accelerating the reform of the ecological civilization system and protecting the ecological environment with a strict system.In response to the practical needs of the improvement of the environmental system and the requirements of the era of ecological civilization construction,the ecological environment damage compensation consultation system was proposed as an institutional innovation in the field of environmental protection norms in my country.Its design purpose is to negotiate with the compensation obligor as the owner of the ecological environment resources on behalf of the state through the relief subject to achieve the purpose of timely and effective restoration of the ecological order and the compensation of ecological losses.At the same time,the consultation system has the characteristics of pre-negotiation,government dominance and compulsory negotiation agreement.Therefore,the introduction of a supervisory mechanism in the negotiation of ecological damage compensation has both its importance and necessity,as well as its rational core.This article mainly uses research methods such as literature analysis,empirical analysis,and comparative analysis.The content covers the basic theory of ecological environmental damage compensation negotiations,the importance and necessity of introducing a monitoring mechanism in ecological environment damage compensation negotiations,and how to introduce a monitoring mechanism..The first part first introduces the purpose of China ’s consultation on ecological and environmental damage compensation.Through research,it discusses the problems existing in the negotiation of compensation for ecological and environmental damage.Based on this,it demonstrates the importance and necessity of introducing a supervision mechanism,and explores the nature and legal basis of its behavior.The second part mainly analyzes the actual situation of the relevant subjects in the supervision of the compensation for the damage to the ecological environment,discusses the actual problems existing in the supervision subjects,the supervision link and the supervision process,and finds out and summarizes the reasons for the problems in the current supervision mechanism.The third part specifically looks for the experience and possible ways to solve the dilemma of supervision of ecological and environmental damage compensation.Based on the full summary of the existing theoretical research and legislative exploration,it explores the perfect path of the supervision mechanism.It is expected that China will improve the compensation for ecological and environmental damage.The consultation oversight mechanism provides some useful references.
