With the advancement of globalization and the awakening of humanism,great changes have taken place in the educational objectives and training objectives of middle schools in China.The educational concept of success or failure based on score is gradually replaced by the educational concept of cultivating morality and students' comprehensive ability.Affected by this,the attitude of all walks of life to middle school teachers to exercise the educational punishment right has changed accordingly.People thought that it was a natural way of educational management for teachers to discipline students,but now the situation has changed.Teachers' carelessness in exercising the right of educational punishment will lead to disputes,and a series of chain reactions will follow.Some parents make trouble on the campus and interfere with the normal order of the campus,some sue the school or teachers to the court,and a few media's shadowy reports push the right of educational punishment of secondary school teachers to the forefront of public opinion,teachers' right of education punishment has become the focus of the society.Therefore,scholars focus on whether middle school teachers should have the right of educational punishment? Where is the boundary of educational punishment? How to implement educational punishment? Such issues have been widely discussed and studied.Middle school teachers' exercise of educational disciplinary power to manage students who violate discipline has rapidly evolved from the ordinary operation in the past into the problem that today's teachers must be cautious to face,because even the slightest punishment is likely to be labeled as corporal punishment.In the case of vague legislation of educational punishment right,teachers can only be forced to deal with those students who violate discipline passively.They often take an indifferent attitude or make a few criticisms.Obviously,educational punishment can not show its due function,and teachers are also in the dilemma of doing something and not daring to do something.That is to say,reasonable punishment of students who violate discipline should bear potential risks,while the the act of failing to perform a teacher's duties can rest easy,but it is obviously against teachers' ethics.Analyzed from the function of school education,it is not only an ideal way to spread human labor experience and impart scientific and cultural knowledge,but also reflects the unique function of moral norms and guidance for students.Therefore,the educational function of education should not be neglected,otherwise education will not be able to answer the question "for whom to cultivate people? What kind of people should we cultivate? " And fall into a state of self loss.Education is a practical science.In this sense,educational activities are always in the process of movement and change.The author thinks that the research on the exercise of educational disciplinary power by middle school teachers will still have important theoretical and practical significance in the future.The research theme of this paper is the dilemma and Countermeasures of junior high school teachers' exercise of educational disciplinary power.The research idea of this paper takes the dilemma and Countermeasures of junior high school teachers' exercise of educational disciplinary power as the main line,and studies from the essence and connotation of educational disciplinary power,the difference between educational disciplinary power and corporal punishment,the important educational role of educational disciplinary power and the dilemma faced by teachers' exercise of educational disciplinary power.By means of questionnaire survey and teacher interview,this paper collects the information and data needed for the research,and objectively describes the current situation and problems of teachers' exercise of educational disciplinary power.Based on the above research and investigation,this paper analyzes the reasons behind the problems,and puts forward some countermeasures that are conducive to the smooth exercise of teachers' educational disciplinary power.This paper is divided into five parts:The first part is the introduction of the paper,which mainly introduces the origin of the topic,research significance,current research status at home and abroad,research ideas and methods.The second part is the definition of the core concept and the analysis of the philosophical theory related to punishment.In the third part,through the combination of empirical research and qualitative research,we carry out research on the current situation of educational punishment in the target sampling schools,collect relevant statistical data and interview materials,analyze and reveal the manifestations of disciplinary disputes and conflicts,as well as the consequences and adverse effects.The fourth part is the analysis of the reasons that affect the current teachers to exercise the right of education punishment.For a long time,the dilemma of educational punishment is caused by many factors.Firstly,one of the important reasons leading to disciplinary disputes is that the legal principle of educational disciplinary power is vague;secondly,the essence of educational disciplinary power is not clearly defined,the supervision mechanism is not perfect and the relief channel is not smooth;Thirdly,there is no unified reference standard for educational punishment,which mainly depends on Teachers' subjective experience;fourthly,some parents lack scientific understanding of the way of educating their children;fifthly,some media over interpret and report on a few teachers' improper punishment;finally,some teachers' understanding of punishment function is too simple and punishment art also needs to be improved.The fifth part is about how to effectively exercise the educational disciplinary power.Based on the above-mentioned investigation and research,the author puts forward some paths and countermeasures for teachers to smoothly exercise the right of educational punishment from the following aspects: strengthening teachers' learning of the newly issued "disciplinary rules for primary and secondary education(Trial)",accelerating the implementation of school rules and regulations and improving the disciplinary procedures,improving teachers' quality and management art,reasonably guiding and standardizing media publicity,and referring to the successful experience of other countries.
