Research On Legal Issues Of Administrative Supervision Of Off-campus Training Institutions

With the development of economy and culture,people from all walks of life have an increasing demand for all kinds of education.Relying only on traditional knowledge can no longer meet people's needs.Under this background,various off-campus training institutions have emerged.However,due to a series of problems in administrative supervision,the good and bad of off-campus training institutions are mixed.If they are allowed to develop,more serious social problems will occur.At present,the academic circle has not paid enough attention to the administrative supervision of training institutions,and there are still a series of problems in legal policies and specific practices.Therefore,the research of this paper is of great significance.From the perspective of administrative law,this paper takes the administrative supervision of non-disciplinary out-of-school training institutions as the research object,firstly defines the basic concept of the research object,and summarizes the legal attributes of non-disciplinary out-of-school training institutions,so as to have an accurate positioning of the research object.Then,it clarifies the subjects and responsibilities of administrative supervision of off-campus training institutions by education administrative departments,market supervision departments,labor and social security administrative departments.Then,it combs the administrative supervision means of administrative organs to the off-campus training institutions,namely,administrative permission,administrative inspection,administrative punishment and administrative guidance,which lays a solid theoretical foundation for the writing of this paper.Then,the main problems existing in the administrative supervision of off-campus training institutions are summarized by using the information obtained by literature research,interview and field investigation.First,the access permission supervision is not perfect,including the off-campus training institutions access standards are not clear,access supervision is difficult to prevent "vacuum" two aspects.Second,the law enforcement inspection system is not complete,mainly manifested in the law enforcement inspection of off-campus training institutions is not in place;Enforcement inspection method is relatively rigid;The law enforcement inspection team is insufficient and its quality needs to be improved.Thirdly,the multi-department joint law enforcement is not perfect,which is mainly manifested by the unclear responsibility of the law enforcement subject and the imperfect joint law enforcement mechanism.Using the theoretical knowledge of administrative law,through the reflection of practical problems and relevant governance experience at home and abroad,this paper puts forward the path to improve the administrative supervision of the above training institutions.First,we will improve the regulatory system for market access and permits.Administrative organs through scientific setting clear access standards and through improving the trust-breaking joint punishment system to improve the training institutions market access licensing supervision,the training market access problem.Second,we will strengthen inspection and oversight of law enforcement.Including the training institutions to improve the daily law enforcement inspection,optimize the law enforcement inspection methods and improve the professional quality of the supervision team.Third,we will improve multi-department joint law enforcement.It mainly includes clarifying the responsibilities of law enforcement bodies and improving the joint law enforcement mechanism.
