Research On The Legislation Of The National People's Congress Based On The Whole Process Of People's Democracy

As the most authoritative and important legislative form in the legislation of our country,the legislation of the People’s Congress is related to the vital interests of the overwhelming majority of the people,so it is necessary to promote the democratic development of the legislation of the People’s Congress in the new era.The wholeprocess people’s democracy,as a new form of democratic development in China,is in line with the law of the development of democratic politics in China,and the People’s Congress is an important application carrier of the whole-process people’s democracy.How to promote the legislative democratization of the People’s Congress in the wholeprocess people’s democracy is worthy of further discussion.This paper takes the whole-process people’s democracy as the research dimension of the legislation of the People’s Congress,and analyzes the whole-process people’s democracy from the perspectives of "subject","process","system" and "value".Among them,the "subject" perspective refers to the breadth and diversity of the participants;the "process" perspective includes the basic procedures of democracy,channels and forms of pluralistic participation;the "system" perspective means that the whole-process people’s democracy itself is supported by a series of systems;and the "value" perspective refers to ensuring that the people are the masters of the country,which embodies a wide range of full,real,concrete and effective democracy.This paper analyzes the appropriateness of the research dimension of the whole-process people’s democracy of studying the legislation of the People’s Congress,and demonstrates that the whole-process people’s democracy and the legislation of the People’s Congress are consistent in theory and coupled in practice.this paper analyzes the mutual agreement between the four perspectives of t the whole-process people’s democracy and the legislative process of the People’s Congress,and then constructs the legislative analysis framework of the People’s Congress based on the whole-process people’s democracy,and examines the various stages of the legislation of the People’s Congress.This article analyzes the three representative stages of legislative planning,bill drafting and bill deliberation in the legislative process of the People’s Congress.On the basis of case analysis,this paper expounds the democratization performance and deficiency of the three stages of the legislation of the People’s Congress from the perspective of "subject","process","system" and "value" of the whole-process people’s democracy.It is found that in the three stages of the legislation of the People’s Congress,the People’s Congress ensures the democratization of the legislation of the People’s Congress through a wide range of participants,clear democratic procedures,and various democratic channels and forms,such as legislative discussion,legislative argumentation,legislative hearing and so on.In addition,by improving the institutional arrangements,we should further give full play to the important role of deputies to the People’s Congress and public participation in the democratization of the legislation of the People’s Congress,which is relatively perfect from the perspective of "subject",the perspective of "process" is relatively systematic,the perspective of "system" still needs to be improved,and the perspective of "system" still needs to be improved.The article holds that the whole-process people’s democracy has comprehensively promoted the democratic development of the legislation of the People’s Congress,and will continue to deepen its development in accordance with the requirements of the times.At the same time,it is necessary to further develop the whole-process people’s democracy in the legislative process of the People’s Congress,to enhance the sense of responsibility of people’s participation in legislation at the level of subject consciousness,to expand the channels for people’s participation in legislation at the level of practical process,to ensure people’s orderly participation in legislation at the level of system design,and to fully reflect the will of the people at the level of value orientation.
