On The Benign Interaction Between Online Public Opinion Supervision And Judicial Trials

Citizens’ speech forms network public opinions under the agglomeration effect of the network.When network public opinions intervene in the judicial field,it will not only play a positive role in supervising the judicial fairness,but also have negative effects such as hindering the independent exercise of judicial power by people’s courts,challenging the judicial fairness and aggravating the crisis of judicial confidence.Through the in-depth analysis,we find that the negative impact is mainly due to inappropriate media,lack of rationality of netizens,immaturity of justice response to public opinions,and the difference between public opinions and justice in evaluation standards and value pursuit,etc.In view of these reasons,on the basis of foreign advanced experience,we should take the following measures: to build a harmonious network environment of public opinion,to improve the mechanism of public opinion of judicial organs,to promote the credibility of judicature.Through these measures,expect to be able to reduce the network supervision of public opinion on the negative impact of judicial adjudication,and ultimately achieve the benign interaction between the two.
