In the new media age,the internet has become an increasingly important channel for expression of public opinion,consequently its influence on the justice system is also growing fast.As an important part of China’s rule of law process,the justice system is increasingly attracting the attention of the public on the internet,and the interaction of which has become inevitable.While public opinion has a supervision function over the justice system,it also has a double-edged sword effect,namely that on the one hand it may promote the protection of the rights of citizens and safeguard the fairness of the judicial system;on the other hand,it may cause undue pressure and challenges the independence of the justice system,which the latter may not be able to reasonably respond or sensibly guide public opinion and form healthy interaction.During the course of interaction,there is a phenomenon that the justice system responses to online public opinion weakly and compromises to it.The British and American justice systems are more experienced in handling public opinion,thus comparatively examining them may shed important light on the problems and ways forward of the Chinese system.In addition to the introduction and conclusion,this paper is divided into three chapters.The first chapter focuses on the concept of the new media age and online public opinion,and the characteristics of online public opinion,and indicates that online public opinion extensively focuses on public affairs that based on its property,and meanwhile it has a feature that it can communicate timely.After that,the attention and influence of online public opinion on justice system are analyzed.And indicating that in the process of interaction,the online public opinion will bring positive and negative influences to the justice system.The positive aspect is the protection of the right to know and the freedom of expression,as well as the supervision of the judicial power.The negative aspect is the challenging to the independence,due process and credibility of justice system.The second chapter mainly analyzes the relevant legislation system and cases of British and American countries during the course of interaction between online public opinion and justice system,This includes the introduction and analysis of the British "Susmith case",contempt of court system and relevant network legislation.It also analyzes the "Zimmerman case" in America,restrictions on media involvement in the trial,rules of the expression in litigation and network legislation.Pointing out that justice system can response to the impact of online public opinion to the greatest and getting healthy interaction between both of them by means of judge’s quality,restricting media and participants in litigation reasonably and legislative regulation.Trying to make a reference and comparison of dealing with current problems in China through the elaboration of the advanced experience of America and Britain.In the third chapter,indicating the dilemma in China is that the justice system responses to online public opinion weakly and compromises to it and both of them can not get healthy interaction.And analyzing the underlying causes,meanwhile,comparing with the experiences of Britain and America,putting forward the way to realize the healthy interaction between online public opinion and justice system in China.
