Nowadays,the rapid development of the Chinese video game market has led to the development of related industries.Among them,the derivative market of video game,video game live broadcast industry develops most rapidly.At the same time,the video game live broadcast industry for the use of video games,caused a series of legal disputes.About video games work on the ownership of the property,or the host in the use of video game products produced in the process of the video game picture of whether worth shall be protected by the law,and broadcast industry if it is for the use of video game screen into related issues such as the rational use of discussion,the characteristics of its essence lies in the video game itself brings the impact of the existing copyright law system framework.Therefore,when discussing the copyright of video game live screen,we can't get rid of the influence of video game itself on live screen.First of all,the first part of this paper to video game live screen related concepts.In the second part,through the analysis of the attributes of video game,the author establishes the attributes of electronic games as the basis of this paper.The third part starts from the object path,analyzes the interactive features of electronic games under the condition of constituting "electronic works",thus establishing the scope of protection by copyright law,and then obtains the deductive works that can be constituted by live video games.The fourth part firstly determines that the live broadcast is regulated by the copyright law of China.Through the combination of China's copyright law and the United States' "four factor standard" reasonable use analysis.Based on the actual situation,it is concluded that the use of video game images in the live broadcast industry lacks the practical and legislative basis for reasonable use.The fifth part,according to the analysis of contents of the full text,from the perspective of interests balance between industry,establish the host can get relating right protection under the general case,and through the electronic competitive sports under the background of the assignment of the right holder of the video game market stability maintenance,finally live video games without authorization from live platform of tort perspective of tort liability.
