The development of network technology has greatly changed the way of information dissemination.In recent years,the emergence of webcasting methods has challenged the traditional copyright legal system.This article uses the copyright protection of online game live broadcast screens as an entry point,and systematically analyzes and interprets three aspects.One is whether the screens involved in the online game live broadcast constitute a work;the second is the role played by the online game anchor in the process of game dissemination.Whether his role is a deductive author or a performer,whether he can enjoy copyright based on his behavior;the third is whether the game anchor is infringing in the process of using the game screen.In the specific research process,this article comprehensively adopts literature research method,comparative research method,case analysis method and other research methods to research and analyze the copyright issues of online game screens.The first chapter of this article introduces the huge economic benefits brought by the online game live broadcast industry,and major capitals are chasing after it.Therefore,the legal relationship of online game live broadcasts urgently needs to be clarified.Solving the work attributes and attribution issues of the game live broadcast screen is to ensure the online game live broadcast.An inevitable requirement for the sound development of the industry.The second chapter of this article divides the online game live screen into three types: the overall game screen,the game live screen and the game live screen,and makes a specific analysis of the copyrightability and copyright ownership of the three types of screens.The fixed works of the game itself are divided into computer software and material libraries,which are protected by the Copyright Law and enjoyed by game developers;the overall screen after the game runs does not need to be protected by a separate “game work” type;The anchor’s commentary in the game live broadcast screen can be regarded as an “oral work” to be protected under the premise of achieving a high degree of originality;the game live broadcast screen constitutes an audio-visual work,and at the same time,considering that the game tournament organizer has invested a lot in the organization of the game tournament,the copyright shall be enjoyed by the organizer of the competition.The third chapter of this article analyzes the types of roles that the game anchor assumes in the process of disseminating the game screen.The anchor is a performer instead of a deductive author.At the same time,referring to the definition of "performer" in international conventions,playing games should be interpreted as acting.The fourth chapter of this article demonstrates that the game live broadcast behavior constitutes reasonable use from two aspects.One is that the game anchor gives the original work new functions and meanings in the process of disseminating the game screen.The second is that the game live broadcast industry will not replace the game industry and detract from the interests of game developers.
