| The difficulty of enforcement has always been a chronic problem in civil execution in China.To solve this problem,the civil enforcement deterrent mechanism was proposed in 2004 and applied to judicial practice.Dominated by the court Civil,with the help of various social forces and the aid of the social credit system,it will restrict and punish those who have the capability but fail to perform the obligations specified in the legal document,and will deter the executed to fulfil their obligations specified in the effective legal documents.Meanwhile,it will encourage the whole society in accordance with the law and be faithful.Compared with developed countries,China’s deterrence mechanism has a relatively short time.So there are many problems such as legislation deficient,judicial confusion and incomplete supporting system.Based on the analysis of the practical trial of this mechanism,to promote sound deterrent mechanism and to solve the in-depth implementation difficulty,this paper puts forward some suggestions on perfecting the legislation of the deterrent mechanism,optimizing the applicable procedures of the deterrent measures,strengthening the joint execution and improving the supporting systems such as the social credit system. |
