The Present Situation And Countermeasures Of "Difficulty In Judicial Enforcement" Of Civil Affairs In Grass-Roots Court,Taking T County People’s Court In Jilin Province As An Example

As the last barrier of justice,the execution procedure maintains the bottom line and dignity of the law.Whether the execution can be done well or not is closely related to the implementation of the national judicial results and the fundamental interests of the people.If we can do a good job in implementation,we can achieve justice for the society and protect the rights and interests of the people.However,based on the objective situation of our country,"difficulty in judicial enforcement" has become the obstruction of promoting the rule of law and implementing the achievements of judicial adjudication.Chinese scholars and practitioners in the legal industry have fully realized the importance of solving the problem of "difficulty in judicial enforcement".After reading the relevant literature,the author has learned that China has done a lot of research and substantive work to solve this problem,and this work is gradually extended from theory to practice,from the top to the end.Therefore,the discussion and research on the problem in the grassroots courts are in line with the current legal environment in China,and more suitable for the research progress stage of solving this problem in China.This paper mainly takes the T County People’s Court in Jilin Province as the research object,collects the relevant data by collecting and studying the civil enforcement case data of the T County People’s Court and visiting the enforcement staff,and studies the implementation status of the T County People’s Court through field inspection and data analysis.Combined with the author’s working experience,it analyzes the reasons why it is hard to realize judicial enforcement.It provides the reference for the national grassroots courts to solve this problem.The "difficulty in judicial enforcement" of civil cases in the T County People’s Court includes the large number of enforcement cases,the difficulty in finding the person subjected to enforcement,the difficulty in investigating the property of the person subjected to enforcement,and the difficulty in disposing of property.The problems in T County People’s Court are typical,but there are also some common problems faced by most grassroots courts in China.It is also unique,which is characterized by many agricultural and forestry cases involved and the complexity of local human relations network.We have gone a long way to solve the problem of "difficulty in judicial enforcement".Only by solving the problems at hand,can we have the confidence to face new difficulties and challenges in the future work.
