| The scope of application of property penalty has been continuously expanded.Additional property penalty in criminal judgment can not only punish and educate criminals,but also conform to the trend of "light punishment".However,in judicial practice,the phenomenon of "empty sentence" of property penalty occurs frequently,the execution rate of property penalty is low,and a large number of property penalty cannot be executed,which damages the authority and seriousness of criminal judgment.Although the constitution and the criminal procedure law endue the criminal execution department of the procuratorial organs with the right to supervise the execution of property punishment,they are deeply influenced by the concept of "emphasizing freedom punishment and light property punishment".This is inconsistent with the increasingly standardized penalty execution system and restricts the penalty execution right.In order to solve these problems,it is necessary to establish a sound and efficient procuratorial supervision mechanism for the execution of property penalty by changing the supervision concept,improving the criminal legislation,reforming the internal system and improving the external procedures,so as to pursue fairness and justice. |
