A Commentary On The Improvementof Procuratorial Supervision On Execution Of Property Punishment In China

Property penalty is a kind of penalty method which takes deprivation criminals of property interests as its content.The execution of property penalty is beneficial to punish,educate and reform criminals economically.Whether the execution of property penalty is in place is directly related to the authority of the people’s court judgment.With the progress of legal system in our country,property punishment has been widely used in all kinds of criminal trial activities.However,in judicial practice,a large number of property penalties can not be effectively implemented,which seriously affects the seriousness of the effective legal documents,and failed to play its due function and role.Therefore,in order to effectively solve the problem of the implementation of property punishment,so that property punishment should play its due authority,it is necessary to further improve the system of execution of property punishment.At present,the procuratorial supervision of execution of property punishment is still in the initial stage of exploration.Strengthening the procuratorial supervision is conducive to the realization of restriction on the power of penalty enforcement,promote the improvement of the penalty enforcement system in China,maintain the unity of the legal system,and ensure the realization of the penalty purpose.By means of empirical study,case analysis and comparative study,this paper summarizes the connotation and basis of the procuratorial supervision of the execution of property penalty in China,taking the connotation and scope of procuratorial supervisionover execution of property punishment as the starting point.This paper clarifies the current legislative situation of procuratorial supervision over the execution of property punishment in China and its actual situation in practice,and deeply analyzed the problems existing in the supervision over execution of property punishment of the procuratorial supervision organ,such as the ideological understanding is not in place,the law regulation is not perfect,the supporting system is not unsound,and so on.In addition,this paper adoptes,absorbes and introduces some experiences and practices of foreign countries on the execution and supervision of property punishment.From the angle of strengthening the idea,enforcing the legislation and perfecting the system,this paper expounds the concrete methods and ways of how to strengthen the execution and supervision of the property penalty.
