Research On The Construction Of University Constitution From The Perspective Of Governing According To The Law

In the process of advancing the comprehensive rule of law,higher requirements have been put forward for the rule of law in university.The important role played by university constitution in the practice of university governance has been continuously demonstrated.Strengthening the construction of university constitution is an important manifestation and vivid practice of advancing the governance of the university by law,and promotes the standardization and legalization of university governance.However,subject to the constraints of traditional ideas and concepts,the constraints of the one-dimensional management model,and the lack of university constitution building capacity and construction experience,from the perspective of governing the university according to law,it can be found that there are still universities in the construction of university constitutions.The formulation of the constitution needs to be improved,the content of the university constitution is relatively rough,the effectiveness of the university constitution is not strong,and the judicial application space of the university constitution is insufficient.In addition,some universities have not developed the constitution for a long time.The lack of comprehensive and thorough understanding of relevant legal issues has led to difficulties in the process of promoting the implementation of the university ’ s constitution,and the effect of constitution building is not ideal.This situation urgently needs to be changed.The construction of university constitution is a systematic project that includes the for mulation,implementation,supervision and evaluation of the constitution.A good constitution is the prerequisite and foundation,and the implementation of the constitution is the key.Only when the university constitution is truly implemented and widely recognized by the members of the university will it not be reduced to a piece of paper.Based on the above background and issues,the first part of this article first clarifies the basic content of theconstruction of university regulations and the promotion of the management of the university according to law,and the basic connotation of the management of the university according to the law,the content of the university constitution construction,the relationship between the management of the university according to the law and the construction of the university constitution,etc.The second part analyzes the overall situation of the university’sconstitution,and comprehensively examines the problems in the construction of the university’s constitution,such as the single body of the constitution,the imperfect formulation procedure,the imprecise content of the constitution,and the difficulty of strengthening the effectiveness of the constitution through judicial application.Combining with the above-mentioned problems,it deeply analyzes the main factors that affect or restrict the construction of university constitution and their causes,so as to find the right direction for solving theproblems.The third part proposes to strengthen the construction of university constitutionfrom the aspects of improving the main body and procedures of the university constitution,setting up the text content of the university constitution,strengthening the effectiveness of the "soft law" of the university constitution,and exploring ways to integrate the university constitution into judicial application suggestions.Through the above argumentation,it is expected to provide a certain theoretical basis,principle guidance and reference information for the construction of university constitution,and promote the process of legalization of Chinese university constitution.
