With the rapid development of Internet economy,online short video has become an important cultural industry,which interacts with e-commerce,education,network broadcast and other industries to promote multi-dimensional cultural communication.At present,there are many problems in the development of network short video industry,and it is urgent to standardize the legal system of copyright.Although changes in copyright law system in our country in 2021 to strengthen the protection of works,but for the short web video standards and rules also lacks the system on the protection,rational use of the way also there is a blank in legislation,in practice the management of the network platform of short video is relatively chaos,network infringement is relatively serious,a short video Courts have different standards of protection for short online videos.This paper firstly defines the connotation of network short video from three factors of time control,long video comparison and review procedure,and analyzes its originality from the aspects of material selection,shooting Angle and post production,affirms that network short video,as a type of audio-visual works,should be protected by copyright law.Secondly,the paper analyses the network short video copyright infringement problem,combing the different types of direct infringement and indirect infringement,combined with the lack of fair use system in China,put forward to determine the different standards of tort liability,contrast "three-step approach",the four essential factors of "standard" and the United States,the rules of "transformation",to "three-step approach" to give priority to,With the "four elements standard" as the auxiliary,the paper confirms the reasonable use of short video on the network,and puts forward that the network platform service providers should bear more strict review obligations under the rules of safe harbor.With the promotion of China’s intellectual property power strategy,the protection of intellectual property in the Internet economy is becoming more and more important.This paper emphasizes the copyright property of short online video,in order to perfect the relevant copyright legal system and find a development path of short online video industry suitable for China’s national conditions.
