Research On Short Video Copyright Protection

With the advent of the Internet information age,media technology is constantly updated.In order to satisfy people’s "fragmented" way of reading,short videos with interesting plots are gradually emerging as media.At the same time,plagiarism and piracy emerge one after another,seriously hindering the development of short video culture industry.To avoid "bad money driving out good money" in the field of short video,this paper is divided into the following five parts to study the protection of short video copyright:The content of the first aspect is: the urgent problem of short video copyright protection.The logical starting point of this paper is the identification of the attributes of short video works,the identification of the fair use of "unoriginal" short video and the identification of indirect tort liability of short video platforms.The second part of the research content is: short video originality identification.By comparing the different standards of originality between copyright system and author right system,the value selection behind each system is found,and the different views on the factors of originality evaluation of short video are summarized,so as to solve the problem of difficulty in the identification of short video works,and pave the way for determining the factors of originality evaluation of post-civilization audio-visual works.The third part is the identification of the fair use of "unoriginal" short videos.Measure the benefits among originator,transmitter and user of works,and discuss the value choice of reasonable use.According to the relevant laws and regulations on fair use,the fair use behavior of "unoriginal" short videos is determined to solve the difficult problem of the fair use of "unoriginal" short videos,and provide a theoretical basis for the following paper.The fourth part is: short video platform indirect tort liability.Based on the principle of technology neutrality and predictability,this paper discusses the requirements for determining indirect tort liability of short video platforms,solves the difficulty in determining indirect tort liability of short video platforms,and lays a solid foundation for improving the relevant legal system of indirect tort liability of short video platforms.The fifth part is: suggestions for the improvement of short video copyright protection.Through the above four parts of the argument and analysis,clear audiovisual works original factor,the regulations of clear and reasonable,perfect the relevant legal system of indirect infringement liability short video platform,make up for a lack of legal system related to the short video copyright protection,to effectively curb the short video copyright infringement phenomenon,short video industry development line reach stabilization.
