Research On Legal Issues Of Short Video Copyright Protection

With the popularization of mobile intelligent terminals and the accelerated pace of life,various short video applications have emerged and developed rapidly.Short video as a new product,in addition to bring people convenience and fun,but also brought many problems to be solved,the most important is the problem of short video copyright protection.According to the idea of raising,analyzing and solving problems,this paper analyzes and studies the difficulties faced by short video copyright protection,and puts forward a series of targeted suggestions for better protecting the legitimate rights and interests of short video copyright owners and promoting the virtuous circle development of short video industry.First of all,focus on short video copyright protection problems.One is that short videos have not been clearly defined in industry or law.Whether the content of short video belongs to the object of copyright protection,if it belongs to,what kind of works.Second,short video involves many rights subject,ownership is not clear.Third,there are many types of infringement disputes in the field of short videos,and the focus of each dispute is also different.Fourth is the low cost of short video infringement and the difficulty of rights protection of the obligee.Fifth is that compared with traditional video,short video has the characteristics of long duration,low cost,simple operation,and strong sociality,which makes it different from traditional video in copyright protection.Therefore,the protection mode of video copyright cannot be directly copied,which is also the necessity of writing this paper.Secondly,the related theories of short video copyright protection are expounded.First is the short video copyright originality standard decision rules.Second is the scope of the copyright object of short video,which determines the degree of copyright protection of short video.Third is the definition of infringement and rational use,analysis of the causes of infringement.Fourth is to analyze the responsibility of short video platforms by combining the “ safe harbor rule ” and “ red flag rule ”.Finally,this paper introduces the basic principles that should be followed in the protection of short video copyright,and then puts forward targeted suggestions from four aspects of legislation,justice,law enforcement and society,so that short video copyright can be better protected.
