Research On Legislative Perfection Of Government Data Sharing

With the advent of the information age,data continue to enter our vision,continue to penetrate into economic life,and become an essential driving force for economic development.At the same time,big data information is gradually applied to government governance.Government data is all kinds of data obtained by the government in various administrative links such as management,governance and service.The overall planning and utilization of data and interest adjustment are the essence of government data sharing.It is also one of the conditions to further deepen reform and promote the replacement of new and old kinetic energy.Government data sharing is the inevitable requirement and guarantee of building a service-oriented government and a "smart" government in the new era.Due to the importance and complexity of government data sharing and its own value,government data sharing has gradually become the emphasis and direction of information resources research.The sustainable and sound development of government data sharing cannot be divorced from a good legal environment.Although China has basic requirements on the sharing process,sharing platform,and sharing supervision and guarantee of government data and information,with the constant deepening of the informatization process,the requirements of government data sharing in the legal system have also continued to grow.Based on the above situations,this paper is aimed at studying the data sharing problems in the field of legislation of the government by analyzing the status quo of current government data sharing in China and the reasons of slow development,and expounds the necessity,feasibility of government data sharing combined with legislative practice in China,as well as putting forward the corresponding suggestions for the legislative perfection of government data sharing in China.This paper is mainly divided into four parts.The first part differentiates and analyses the government data sharing related concepts,expounds the relevant theoretical basis,and analyzes as well as elaborates the necessity and great significance of legislative research on government data sharing;the second part teases out the status quo of the establishment of laws and policies at the central and local levels.The third part analyzes the problems existed in the current legislation in China from the establishment of policy and law and the present situation,that is,low legislative level,inchoate legal principle,unclear ownership of data rights,imperfect government data information security legislation and so on.The fourth part puts forward some suggestions on improving the legislation of government data sharing in allusion to the existing problems of government data sharing in China.
