Study On Legal Regulation Of Water Environment Safety Risk Prevention And Control In Hanjiang River Basin

The 19 th National Congress of the Communist Party of China put forward a new goal of ecological environmental protection in 2035,that is,"the ecological environment has fundamentally improved,and the goal of a beautiful China has been basically realized",and this beautiful vision has pointed out the direction for water ecological environment protection.As the first tributary of the Yangtze River,the Han River plays an important role in promoting economic development of central and western China and strengthening the north-south transportation in China.However,with the rapid development of China’s economy,the ecological environment of the Han River Basin is also facing significant risks and challenges.This paper is divided into four parts to study the legal regulations of water environment safety risk prevention and controls in Hanjiang River Basin.The first part is to understand the current research status of water environment security,basin water environment security and risk definition by means of literature research,determine the concept of basin water environment security,and find the current situation of the hanjiang River Basin facing serious problems of water bloom,water quantity reduction and water quality pollution.The second part studies the current situation and predicament of the legal regulations of water environment safety risk prevention and controls in Hanjiang River Basin,and it can be seen that although some achievements have been made in the legal regulation of water environment safety risk prevention and control in Hanjiang River Basin,there are still some problems in legislation,law enforcement and justice.The legislative aspects are mainly manifested in the lack of prevention regulation in advance of legislation,the related legislation is still to be perfected,the related legislation is too principled,and some laws are not coordinated;Law enforcement is mainly reflected in the fragmentation of law enforcement system;The judicial aspects mainly show that the judicial preventive function is insufficient,the integrity and coordination need to be improved,and it can not effectively deal with the challenge of water environment safety risk in Hanjiang River Basin.The third part mainly summarizes the experience of legal regulation measures of water environment safety risk prevention and control in foreign basins,as well as the enlightenment of water environment safety risk prevention and control in China’s basins.Based on the successful governance experience of the United States,The European Union and Japan,and the specific national conditions of China,this paper analyzes the enlightenment of the above-mentioned countries on the legal regulation of China’s basin water environmental security risk prevention and control,which is pointed out that the enlightenment of the above countries to the legal regulation of water environment safety risk prevention and control in China is mainly reflected in the following points: firstly,improve the laws and regulations of basin management;secondly,strengthen unified planning and coordinated management of river basins;thirdly,establish watershed management agencies and establish effective public participation mechanisms.The fourth part is based on the specific national conditions of Our country and reference to foreign experience,put forward the countermeasures and suggestions for the legal regulation of water environment safety risk prevention and control in hanjiang River Basin.Specifically,the first part is to implement the principle of risk prevention and build a systematic legal regulation system of risk prevention and control.the second is to establish a new law enforcement relationship and strengthen the public’s substantial participation and supervision mechanism construction;the third is to enhance the initiative and synergy of the water environment safety justice in the Han River Basin based on the overall perspective.
