Since the 21 st century,the Internet industry has been booming.In recent years,mankind has entered the era of big data,and legal norms are far behind the trend and direction of the development of The Times.China’s current law only recognizes citizens’ legal property(such as income,equity,savings,etc.),and does not make clear provisions on whether virtual property belongs to legal property."Civil Code" in the general section of the network virtual property only made guidance provisions.It seems that the relevant laws and regulations of online virtual property transaction in China are vague to a certain extent,especially the protection of the property rights and interests of individual users of online virtual property,which is in urgent need of clarification.This paper aims to study the protection of individual users’ rights and interests of network virtual property,and the scope of study is limited to network virtual property transactions.The main purpose of the study is to discuss which party the rights and interests of the network virtual property of individual users belong to,analyze the current situation of the protection of the rights and interests of the network virtual property of individual users in the field of the network virtual property transaction in China,and explore how to realize the effective protection of the rights and interests of the network virtual property of individual users.The novelty of this paper mainly lies in the introduction of relevant hot cases to study the protection of individual users’ rights and interests of virtual property by seizing the opportunity of guiding provisions on the legal protection of network virtual property after the issuance of The Civil Code and long-standing theoretical disputes in the academic world.The expected research results of this paper are to further put forward suggestions for the protection of personal virtual property rights and interests in the future online virtual property transactions in China by describing the problems caused by the current online virtual property transactions in China and analyzing the current situation of relevant legal protection.The research of this paper is mainly divided into four parts.The first part is the introduction,which mainly includes the research background of this paper,summarizes the research status at home and abroad,introduces the research significance,ideas and methods of this paper,and finally points out the innovation and deficiency of this paper.The second part focuses on network virtual property transactions individual users of the need for virtual property rights protection are analyzed in detail,mainly from the particularity of network virtual property transaction,network virtual property transactions in personal problems those users to protect virtual property rights,and protect trade individual users in the meaning of network virtual property rights are discussed.The third part introduces two cases to analyze the current situation of the protection of personal users’ virtual property rights and interests in China’s practice.The fourth part puts forward specific suggestions and assumptions about the protection of individual users’ virtual property rights and interests in China’s online virtual property transactions. |
