The era background of the Civil Code and the rise of the mobile internet wave have made the issue of virtual property inheritance a hot and difficult topic in this era.The traditional single form of property rights protection and inheritance rules cannot effectively solve the related problems caused by virtual property inheritance.At present,the virtual property inheritance system still faces legal difficulties,and at the legislative level,it has not fundamentally solved the problem of the attribute positioning and essential attribution of virtual property.In addition,in practice,the difficulties in providing evidence for inheritors,the lack of property evaluation standards,and conflicts with privacy protection systems and network user agreements still need to be resolved,It is necessary to reverse the construction of the legislative system for virtual property inheritance and the improvement of the judicial system from the perspective of judicial practice and legal research.This article focuses on the common problems and solutions of virtual property in inheritance,analyzes the legal attributes of virtual property,identifies its relevant positioning in inheritance law,and further explores the issue of virtual property inheritance,summarizing the inspiration for relevant legal work in China.Firstly,this article discusses the legal nature of virtual property,elaborates on the basic concepts of virtual property,and analyzes the basic properties of virtual property,thereby analyzing the legitimacy of inheritance.Focus on the current social background and actual situation,identify the legislative and practical difficulties in virtual property inheritance in today’s society,and analyze the problems from multiple perspectives.Focusing on studying the historical development and legal formulation of virtual property inheritance outside the region,examining the development laws and institutional improvements in the process of extraterritorial evolution,providing valuable experience and inspiration for our country’s legislation and court judgments related to virtual property inheritance.Mainly addressing the legislative and practical obstacles faced one by one,we propose suggestions to improve China’s virtual property inheritance system,hoping to solve the legal difficulties of virtual property inheritance in China.
