The information technical development, not only changed our current social economic structure for long time, but also changed our values and behavior method, formed a kind of all new social space network. People can live, work, marry and play games in this virtual world. A huge new industry has been already formed. The network virtual property is building up a kind of all new economic system, and pound at existing law, economy and people of cognition.The fast development of network urges to born the bargain market of virtual property of net, up to June 2011, our country netizen amounts to 485 million, the universality of the network leads to 36.2%. Along with the rapid development of network economy and the unremitting progresses of society, more and more problems caused by network virtual property are becoming the focus of social concern. On the other hand, faced the increasing virtual property dispute and the lacking of law, it is quite difficult for judicial organ to take up this kind of dispute. For network virtual property, should be subjected to protection of the law is need not to doubt, but the lacking of law in the reality resulted in the rights of many network customers cannot get an effective guarantee.The network industry of China is developing rapidly, the dispute caused by network virtual property also is to pile up one after another. To protect the network virtual property have already become an urgent problem that needs lawgivers create the laws of network virtual property impel the network business developing healthily. This thesis will discuss the tracing to origins of the phenomenon of network virtual property, also the property and dispute of ownership, and how to protect network virtual property this newly arisen property by lawmaking protection.
