Research On Problems And Countermeasure Of Comprehensive Administrative Law Enforcement In Yiwu City

In China,urban management and administrative law enforcement started earlier,but with the accelerating process of urbanization,various deficiencies of urban management,such as multi-department management,power and responsibility mismatch,have begun to appear.At the same time,the former way of urban management is no longer meeting the increasing requirements for the urban environment raised by the citizens.This situation has become the obstacle for city to get a higher progress.In order to distribute powers and responsibilities reasonable during administrative law enforcement in order for high efficiency of law enforcement,the concept of relatively centralized exercise of administrative punishment power began to come into present,which alleviated the situation of multiple law enforcement and overlapping responsibilities to a certain extent.At the same time,in order to better remove the barriers encountered in administrative law enforcement work,comprehensive administrative law enforcement came into being.Comprehensive administrative law enforcement means that the functions and powers previously distributed among administrative departments are taken over by an administrative organ or a statutory organization through legal procedures.This is a further deepen and explore in the relatively concentrated administrative punishment power under the tone of the relatively concentrated administrative punishment power as well as another major exploration on the law enforcement agencies and law enforcement system aspect,which have greatly promoted the reform process of administrative law enforcement.Through the research on the materials of comprehensive administrative law enforcement domestic and overseas,the author finds that there is a lack of theoretical basis and concrete experience for practice guidance.Therefore,Therefore,the results of in-depth research on comprehensive administrative law enforcement can enrich the theoretical basis and practical experience accumulation in this field.Yiwu is the first city that carried out the reform of comprehensive administrative law enforcement in Zhejiang Province.After more than a decade of reform since 2004,Yiwu has achieved a number of reform achievements,but at the same time,many problems have been exposed in the process of law enforcement.Nowadays,the comprehensive administrative law enforcement of Yiwu has encountered greater challenges as a result of rapid development of city area and multi-functional.The primary task of the comprehensive administrative law enforcement is to standardize the comprehensive administrative law enforcement effectively,get out of the current predicament of the administrative law enforcement,and make the comprehensive administrative law enforcement conform to the original goal of reform.This essay researched the problems and challenges of Yiwu Comprehensive Administrative Law Enforcement Bureau meet under new situation and environment.Several rationalization proposals have been raised for Yiwu comprehensive administrative law enforcement in accordance with author’s practical work experience.This research raised several rational solutions to the problems occurred in the current work and enriches the theoretical basis and practical accumulation work.Based on the introduction and sorting of relevant concepts,this essay introduces the history of Yiwu.Comprehensive administrative law enforcement and carries out a questionnaire survey and interview from multiple aspects in view of the current work situation firstly.Secondly,according to the results of the questionnaire survey and interview as well as author’s own work experience,this essay analyzes the main problems in Yiwu comprehensive administrative law enforcement.Including the imperfect law enforcement guarantee mechanism,the law enforcement team construction needs to be improved and the improperly using of discretionary power.Finally,in order to make the comprehensive administrative law enforcement can obtain healthier development and improve the image of law enforcement departments in the public’s mind as well as improve the efficiency of law enforcement.In view of the root cause of the problem,this essay puts forward the main countermeasures,such as optimizing the law enforcement guarantee mechanism,strengthening the construction of law enforcement team,and improving the exercise of discretionary power.Only in this way can government’s capacity for law-based administration improve and make active exploration for the construction of legal government.
