Over the past 40 years of reform and opening up,the level of urbanization in my country has developed rapidly,the scale of cities and towns has continued to expand,and the level of construction has been continuously improved.The task of maintaining the healthy development of cities has become increasingly onerous.As a result,the status and role of urban management has become increasingly prominent,and urban management law enforcement is playing an increasingly important role in maintaining urban environmental order.Since the implementation of the pilot project of relatively centralized administrative punishment power in my country in2002,the administrative law enforcement agencies of urban management in various regions have carried out a lot of fruitful work,basically solving the problems of multiple law enforcement,repeated law enforcement,unfair law enforcement,and low efficiency.However,there are still problems such as irrational allocation of comprehensive administrative law enforcement powers,weak law enforcement coordination,and insufficient social support for comprehensive law enforcement.To this end,it is necessary to improve comprehensive administrative law enforcement related systems,establish and improve comprehensive law enforcement related working mechanisms,and improve the construction of law enforcement teams.This article first introduces the concepts of urban management,comprehensive administrative law enforcement,joint law enforcement,and relatively centralized punishment power.It summarizes relevant domestic and foreign research results and advanced work experience,and is guided by the theory of holistic governance and seamless government Research through literature research method,interview method,and field survey method.The fourth part of this article analyzes the reasons for the problems existing in the reform of comprehensive administrative law enforcement in R City.The first is from the constraints of the traditional administrative model: the departmental cooperation mechanism is not smooth,the phenomenon of penal escrow is widespread,and there is a lack of effective linkage mechanism.,The linkage between horizontal departments and vertical upper and lower levels is not strong.The boundary of power and responsibility is unclear,the boundary between law enforcement functions and the functions of the original administrative department is blurred,and disputes between law enforcement subjects continue.The second aspect is the rules and regulations: the basis for law enforcement is weak,the reform implementation mechanism is not perfect,and the construction of law enforcement teams cannot meet the requirements.The third aspect is the difficulty of law enforcement caused by external resistance: the public has low legal literacy and low social participation.The fifth part provides reform suggestions from three aspects.The first is to optimize the allocation of comprehensive administrative law enforcement powers.It is necessary to reasonably grasp the scope of function transfer,further improve the power list system,and improve the supervision and implementation mechanism.The second is to establish and improve related work mechanisms for comprehensive law enforcement,improve and improve laws and regulations,further standardize the public service cooperation system,establish a unified command and rapid linkage work system,and create a smart urban management system for shared and co-governance.The third is to improve the ability and level of law enforcement services,strengthen the strength of the law enforcement team,improve the legal level of law enforcement personnel,and enhance the standardization level of law enforcement.Finally,I hope this paper can provide a reference for the comprehensive administrative law enforcement reform in R City. |
