Study On Legal Obligation Of Electric Power Enterprises To Support The Development Of Renewable Energy

China is rich in wind energy resources,and the large-scale development of wind power is of great significance for adjusting the energy structure,promoting economic transformation,alleviating the pressure on energy and the environment,and promoting the sustainable development of the economy and society,as a developing country,China should take the responsibility to the world for increasing the proportion of non-fossil energy consumption and reducing carbon emissions.However,in some regions of China,such as Gansu,Ningxia and other northwest regions,wind power provinces have abandoned wind phenomenon.At present,the problem of abandoning the wind is already imminent.Taking into account the environmental public interest lawsuit filed by the Environmental Public Interest Organization "Friends of nature" in 2016 and rejected in 2018,and finally filed in2019 by the State Grid Ningxia Electric Power Company and the State Grid Gansu Electric Power Company,this paper studies the obligations of electric power enterprises to support the development of renewable energy.Taking this as the starting point,this paper analyzes and summarizes the current laws and regulations related to renewable energy in China,as well as the existing problems and deficiencies,combing the status quo of the obligation of purchasing renewable energy for power generation,the situation of fulfilling the obligation,and the reasons for the abandonment of wind by power grid enterprises,put forward the necessity,legitimacy and obligation of solving the current obligation of power grid enterprises to acquire renewable energy for power generation,from the aspects of legislation,law enforcement,judicature,law-abiding and national energy policy,this paper puts forward some effective measures for power enterprises to undertake the obligation of wind power purchase.This paper follows the train of thought of "putting forward the problem ——Analyzing the problem —— Solving the problem",and discusses the obligation of electric power enterprises to support the development of renewable energy.This article takes "Friends of Nature" lawsuit network "abandon wind" case as the breakthrough point,analyzes the industry problem through the case step by step,and proposes the concrete measures to solve the problem.First of all,the legal obligation of power enterprises is expounded,and it is pointed out that not only power grid enterprises have the responsibility of full guaranteed power generation and the legal obligation of supporting the development of renewable energy,as a power generation enterprise,it should also have its corresponding legal obligation.According to the conclusion of obligation,power enterprise must fulfill the relevant obligation before it can obtain the realization of self right.Then,by combing the status quo of wind power industry in recent years,the paper points out the severity of the problem of "wind-abandoned and power-limited" in China,and the status quo of the electric power enterprises fulfilling the legal obligation of supporting the development of renewable energy.By investigating the problems and digging into the roots,we can find that the current legal system of renewable energy in our country lacks scientific legislation,the efficiency of law enforcement is restricted,the judicial function is weak,and the legal concept of environmental protection is weak,in order to solve the above problems,put forward the corresponding legal implementation path,the concrete measures are as follows: establishing perfect legal system of renewable energy,perfecting corresponding provisions of mandatory legal responsibility,perfecting implementing rules of supporting policies,detailing rewards and punishment measures;In the aspect of law enforcement,it is necessary to define the subject of market supervision,establish an efficient and centralized law enforcement system and strengthen the construction of law enforcement team In compliance with the law will be legalized enterprise environmental training,broaden the participation system of power enterprises,the establishment of power enterprises credit system.Through the top-level design,the use of comprehensive legal means to promote the power enterprises to support the development of renewable energy legal obligations,promote the healthy development of renewable energy industry.
