| As the foundation of China’s social security system,the minimum living security system for urban residents is the guarantee line for their basic survival.Since the implementation of the minimum living standard security system for urban residents in the1990 s,it has played an important role in alleviating urban poverty,maintaining social stability for more than 20 years.With the continuous development of China’s economy and society,the President Xi Jinping put forward in the report of the 19 th National Congress of the Communist Party of China that China’s socialist construction has entered a new era.The contradiction between the needs of people’s growing needs for a better life and the unbalance and inadequate development has become the social principal contradiction.The change of social contradictions has put forward higher requirements for ensuring and improving people’s livelihood.In the face of such an environment,how to further improve the basic living standards of the poor and adapt to the needs of people’s livelihood has become a problem closely related to maintaining social order,building harmonious social relations and promoting social progress.At the same time,according to the new goal of "helping the weak" put forward by the 19 th National Congress of the Communist Party of China,promoting the development of social assistance is more in line with the requirements of the new era.We should provide scientific and reasonable legal system support for the social assistance of the urban poor under the background of building a country ruled by law.Therefore,based on the investigation and analysis of Changchun City,this paper studies the minimum living standard security system of urban residents from the perspective of law,and provides legal suggestions for the further development and improvement of the system,so as to provide relevant reference opinions for other cities and even the whole country to implement the minimum living security system for urban residents,so as to further supplement and enrich the theoretical system of China’s social assistance system,which is conducive to promoting the legislative process of relevant systems.The paper is divided into five parts:The first part is "Introduction".First,it introduces the background of the topic and the significance of this topic,then combs the domestic and foreign research status of the minimum living security system of urban residents,and finally introduces the main content of the paper.The second part is "The establishment and development of the minimum living standard security system for urban residents in China".It discusses the background of the introduction of the system,and describes the process from the establishment to the promotion and development of the system.The third part is "The empirical investigation and Analysis on the minimum living security system of urban residents in Changchun City".It introduces the general situation of the minimum living standard security system of urban residents in Changchun City,and combs the laws,regulations and normative documents on which the minimum living security system for urban residents is implemented in Changchun City.And through the relevant investigation methods,this paper sorts out the data obtained from the minimum living security system of Changchun city residents,and analyzes the legal problems presented in the investigation.The fourth part is "The legal system of relief in British and American and its enlightenment to China".Through the investigation of the British national assistance system and the American social relief system,the paper puts forward the enlightenment for the development of the minimum living standard security system of urban residents in China.The fifth part is "Legal suggestions on improving the minimum living standard security system of urban residents in China".According to the summary and analysis of the previous research and the experience and Enlightenment of foreign relevant relief systems,this paper puts forward legal suggestions on improving the minimum living standard security system of urban residents from the aspects of legal system,relief methods,optimization procedures and right relief. |
