Legal Research On Child Abuse Prevention System

Over recent years,the child abuse incidents have occurred frequently in various places.From “Qigu Child Abuse Case” to “4-23 Jiansanjiang Child Abuse Incident”and then to “Fushun Child Abuse Case” which has caused a mighty uproar in the whole nation,child abuse issue has become a prominent social issue.Child abuse is not only closely related to the health of the children,but also concerns the future of the country,because children,as the masters of the society in the future,are able to have impact on the direction of the country in the future.Briefly speaking,the development of the children is the development of the country,and ensuring the healthy growth of the children is to ensure the prosperity of the country,which are the necessary conditions for social development.Despite the current “rule of law” construction in China is improving continuously along with the economic development and the progress of the society,and the awareness of the people in using the legal weapon to safeguard their basic rights and interests is also being raised gradually,the cognition of children is not fully mature and they still can not effectively protect their rights and interests when there is any infringement on such rights and interests,and hence need the country to offer special cares to them.In particular,the frequent occurrence of child abuse incidents over recent years well indicates the need of China to increase its concern on the child abuse issue.Children,as a disadvantaged group,have no strength to fight back when they have any conflict of interest with any person,so they are extremely susceptible to injury,which will have serious impact on their physical and mental development and will further affect the social development.Though China has adopted a number of laws,including the Law of the People’s Republic of China on the Protection of Minors,Civil Code,Law Against Domestic Violence,etc.,to prevent the occurrence of child abuse incidents,still the lack of specific operability for all those laws has made it difficult for child protection in China.The absence of the abuse prevention and intervention mechanism results in constant infringement on the rights and interests of many children.Chiefly by explaining from three aspects,namely,the definition of the concept of child abuse,its intervention beforehand and its relief afterward,this paper has found a set of civil law based child abuse prevention and control measures which is consistent with China’s national conditions.with the hope to make a small contribution to the improvement of the living and development environment for children in China.
