Research On The Implementation Of Public Cultural Service Guarantee Law Of The People’s Republic Of China

The Fifth Plenary Session of the 19th Central Committee of the Communist Party of China proposed to build China into a powerful country in culture,education,talent,sports and health.The national quality and the level of social civilization will reach a new height.The country’s cultural soft power will be significantly enhanced.The basic public services will be equalized.The public cultural service system and cultural industry system will be improved.The people’s spiritual and cultural life will be increasingly enriched,As one of the main goals of economic and social development during the "14th five year plan" period.On March 1,2017,after the implementation of the law of the People’s Republic of China on the guarantee of public cultural services(hereinafter referred to as the law on the guarantee of public cultural services),relevant special laws were formulated according to the establishment of relevant public cultural service institutions in the law on the guarantee of public cultural services.Among them,the most comprehensive one is the public library law of the People’s Republic of China(hereinafter referred to as the public library law)for public libraries,as well as the relevant laws and regulations on public libraries formulated by various places.The improvement of relevant mechanisms of public libraries provides reference for the improvement of relevant public cultural service facilities included in the public cultural service guarantee law.At the same time,some provinces in China began to formulate regulations on the protection of public cultural services,such as Anhui Province,Zhejiang Province and Chongqing Province.From the perspective of Sichuan Province,in order to ensure the smooth operation of public cultural service funds in Sichuan Province,the "measures for the management of special funds for the construction of public cultural service system in Sichuan Province" has been formulated,and the "Regulations on the guarantee of public cultural services in Sichuan Province"(hereinafter referred to as the "Regulations")has also been open for opinions since May 30,2020.As an important system in China,the research on the implementation of laws and regulations is a timely and effective feedback to the current local legislation.Therefore,through the study of the implementation effect of policies and regulations,it is helpful to find the problems in the implementation of policies and regulations,so as to provide strong support for the revision and improvement of policies and regulations.The main contents of this paper are as follows: the first chapter introduces the basic situation of the investigation,the reasons,the process and the methods of the investigation in C County of Mianyang City.The second chapter is the research data collation and analysis.It compares and analyzes the existing laws and regulations related to the public cultural service guarantee law,and sorts out the public cultural service situation of C County in Mianyang City.It is found that there are some problems in C County,such as insufficient publicity of the public cultural service guarantee law,unbalanced regional development of public cultural service facilities construction,relatively backward talent team in the service system,lack of publicity of the public cultural service guarantee law,unbalanced regional development of the public cultural service facilities construction,and so on The lack of public legal awareness leads to the limited supervision and the use of public cultural service facilities in commercial activities unrelated to public cultural services.The third chapter mainly puts forward the countermeasures to optimize the implementation of the public cultural service guarantee law in C County.First,we should strengthen the publicity of the rule of law and the construction of talent team.Second,we should provide public cultural service facilities according to local conditions.Third,we should protect the daily public cultural services of the masses according to law.Fourth,we should investigate and deal with public cultural service facilities used in commercial activities unrelated to public cultural services according to law,The fifth is to strengthen the supervision of the implementation of the law,and the sixth is to strengthen the supervision of the funds of public cultural service facilities.This paper selects C County as the research point for empirical investigation.After collecting the data of the implementation of the public cultural service guarantee law in this area,it makes value judgment and qualitative and quantitative analysis on the impact of the law on C County after its promulgation and implementation.At present,there are relatively few researches on the implementation of the public cultural service guarantee law in a specific place on the Internet,The research angle of this paper has a certain practical significance.
