Post-legislative Evaluation Study

Post-legislative evaluation is maturer in foreign country of legislative theory and practice.Howerver,in China,the evaluation of the post-legislation starts later,the practice applies are gradually expanding from the local area to the central government based on the accumulated relevant experience.Due to the unsound laws and regulations after the regulation legislation,and the academic circle has not formed a mature and unified theoretical system,the theory and practice of evaluation have been a little thin.The article focuses on four parts analyses of the construction of local legislation in China:The first part is overview of post-legislative evaluation.Through its emergence and development in our country,puts forward the definition of the scholars of the evaluation of the legislative,compare the difference between its and related concepts,analyzes the content of the assessment,and further illustrates the necessity of evaluation,lead to main content of this article.The second part is about the subject of post-legislative evaluation.Introducing and analyzing our country present evaluation subject systemto internal assessment give priority to,to external evaluations is complementary,through the analysis of the theory and trend of the third party assessment,more foreign subject setting,the main body of our model is constructed.The third part is the standard and method of post-legislative evaluation.Standard: From the two aspects of theory and practice,the representative viewpoints and examples are analyzed in detail,and the existing standards are listed and the standard system of this paper is constructed.Method: We try to improve the evaluation method in this field by referring to the analysis of cost-benefit analysis and sociology in the field of economics.The fourth part introduces the feedback of the evaluation results.Through the evaluation of legislation,the improvement of normative documents should be improved,so as to improve the law and better guide social life.
