Investigation And Research On The Difficulty Of Execution Of Civil Cases In Grassroots Courts

The phenomenon of difficult execution is a big problem faced by courts all over the country for a long time.Therefore,the Party Central Committee clearly proposes to solve the problem of difficult execution.In order to implement the central decision-making and deployment,the Supreme People’s court solemnly promised to basically solve the problem of difficult implementation in two to three years and achieve the goal on schedule.At the same time,Zhou Qiang,President of the Supreme People’s court,announced at the second session of the 13 th National People’s Congress: after basically solving the problem of enforcement,we should strike while the iron is hot,speed up our efforts,and seize the opportunity to effectively solve the problem of enforcement.In order to move forward to the goal of solving the difficulty of enforcement proposed by the Party Central Committee,the Supreme People’s Court issued the outline of the people’s court’s enforcement work(2019-2023).It can be predicted that the enforcement work will still be the focus of the court’s work in the future.As the main position of execution,grass-roots courts are responsible for the execution of the vast majority of cases.To study the difficulties faced by grass-roots courts and put forward countermeasures and suggestions will help to solve the difficulties in execution and achieve the goal as soon as possible.Based on this,through the field research on the implementation of L District People’s court,this paper understands the achievements of L District People’s court in the implementation,summarizes the highlights of its work,and intuitively understands the reasons behind the difficult implementation of L District People’s court,and puts forward countermeasures and suggestions,hoping to contribute a little to the realization of the goal of solving the difficult implementation of L District People’s court Wish is also the original intention and motivation of writing this article.This paper is divided into five parts.The first part is the introduction,which is composed of three parts: the reason of topic selection,research significance and domestic research status.The first chapter is divided into two parts.First,it introduces the basic situation of the research,including the research purpose,research point selection,research process,research methods,and then it is the collation and analysis of the research data,from the enforcement rate of the court executive board,the situation of the implementation object,the evaluation index of the quality and efficiency of the implementation,application rate of termination of this execution procedure,the number of cases closed per executive judge,the application of the crime of refusing to implement the judgment and ruling Six aspects to sort out the survey data,using the form of chart to intuitively show the implementation of the local court.The second chapter focuses on the highlights of L District Court’s enforcement work during the period of decisive enforcement difficulty,that is,the efforts and practice made by the court to solve the problem of enforcement difficulty.Through reading the implementation materials of the hospital and interviewing the executive judges during the investigation,the author summarizes the highlights of the hospital’s implementation work into eight measures,in order to intuitively show the positive actions of the hospital in the implementation work.The third chapter is the manifestation and cause analysis of the difficulty in the enforcement of civil cases in L district court.It is worth mentioning that after the basic solution to the difficult execution campaign,we have formally moved towards the practical solution to the difficult execution work,and the network inspection and control means have been widely used in the execution work,and the multi department execution linkage mechanism has been established.Many of the original difficult execution problems have been further solved.Although they have not been completely solved,they no longer restrict the smooth implementation of the court The resistance of the exhibition.The fourth chapter is to put forward the countermeasures and suggestions to solve the problems in the third chapter.The countermeasures and suggestions are divided into four aspects: improving the social credit system,constructing the exit mechanism of cases without property for execution,strengthening the construction of execution team,improving the execution ability,and strengthening the execution deterrence.
