Legal Analysis Of The Semicolon Problem In The Legal Text Of Administrative Penalties

Legislative techniques are regular methods and techniques which shall be abided by in the legislation.The legislative techniques are accompanied by the legislation and they are mutually restricted.The legislative techniques affect sections,qualities of norms,technical unity of the latter and implementing effects of the laws.In addition of having prescriptivity,rationality and systematicity,the legal text of the administrative penalties needs to focus on the rationality of contents of the legislation,abiding by technical standards of the legislation and maintaining the unity of forms of the legislative techniques.The research purpose of this paper is to improve the application of semicolon in the norms of the legislation.Taking the problem of the application of semicolon in the legal text of administrative penalties as a main research content,the paper holds that different interpretations of clauses before and after the semicolons lead to differences through analyzing current situation of the norms of the legislation and application of law enforcement.Second,the paper believes the reasons causing the difference of application in the law enforcement authorities are flaws of standards in the legislative techniques,which result in equal punishments by the law enforcement authorities.The paper suggests that the semicolon shall be functioned as pauses in the tones,prohibiting the authorities to give more meanings for the semicolon.Meanwhile,comparing differences between the legislations in the central government and Taiwan,the paper analyzes how the legislation in Taiwan uses punctuation marks in multi-clause sentences.Last,the paper suggests that semicolons can be used in the administrative penalties,but their functions shall be defined and their meanings shall not be exaggerated in the legislation or law enforcement for the purpose of not causing ambiguities.In the perspective of legislation,the ambiguities in law enforcement are caused by the imperfection of the legislative techniques,which causing ambiguities in the law enforcement authorities.The paper calls on the authorities to improve the legislative techniques,defining the goals of the legislations and hopes the legislative techniques can be improved and unified to avoid occurrence of similar problems under requirements of “good laws”.In the perspective of law enforcement technologies,using semicolons in multi-clause sentences is the tradition of legislation in the legal text of administrative penalties in China.It will not be changed in a short time.The law enforcement authorities shall use legal interpretation suitably and applicably to solve the current dilemma based on the statutory punishment principle when facing with the problem.
