Study On The Application Of The Anti-drug Law In The Practice Of Drug Addiction

So far,the struggle against drugs is still a worldwide problem,in which drug prevention,drug rehabilitation,relapse prevention and aiding addicts have always been the focus and difficulty of all countries dealing with drug control and drug treatment.The “Annual Report on Drug Control in China in 2018” released by CNNCC pointed out that by the end of 2018,there were 2.404 million drug users throughout the country(excluding the number of deaths,departures and relapses not found in three years of withdrawal).It is not optimistic that new drugs are emerging,new psychoactive substance abuse is increasing and drug users are appearing at younger ages.The Anti-Drug Law of the People’s Republic of China was deliberated and released by the Standing Committee of the National People’s Congress on Dec.29th,2007 and thus took effect on June 1st,2008.As the country’s first law to comprehensively regulate drug control,it regulates the basic experiences of drug control policy and drug treatment system formed in China’s long-term practice.It reconstructs our drug treatment system and highlights the major changes and progress in the concept of drug users in China.It also builds a more perfect legal system of drug control,which has provided laws for promoting drug control in China and marked that our drug control are formally on track of legalization.At the meantime,however,during its eleven years of implementation,it has gradually showed some unexpected situations in the application of law.For instance,the legal effect does not match the purpose of legislation,the operation of the system conflicts with the idea of legislation and the management system contradicts the principle of legislation.In particular,measures of drug treatment do not have a smooth connection with each other in real practice,which leads to their unsatisfactory performances and thus affects the real effects of drug treatment to a large extent.Starting with the actual application of drug treatment measures established by the law in Shanghai,the thesis,in contrast to some patterns of drug treatment abroad,focuses on the analyses of the status orientation to drug users,regulations of legal procedures and connection between different drug treatment measures.It aims to solve the current difficulties in the application of the law and promote a harmonious development between our system and the national trend of drug control.In order to highlight the characteristics and advantages of China’s current drug treatment system,methods and ideas to further improve the system will be put forward.
