Empirical Research On Drug Crime Governance

Drugs,drug crimes and drug addicts are a set of concepts of circular promotion.As the two ends of the drug economy,the objective existence of drugs and drug addicts will inevitably lead to the occurrence of drug crimes in the middle link of the drug economy.The main content of this paper is how to control drug crime.This paper mainly through the empirical analysis method,and then select the operational effectiveness of drug control policy and the punishment treatment of drug offenders to explore the way of drug crime governance.There are three parts in this paper:The first part introduces the conceptual and practical problems in drug crime control.The conceptual problems are mainly reflected in two aspects.Firstly,the aim of drug control should be to prohibit drug and drug crimes or to control and govern the drug and crime.Secondly,have we realized the objective existence of drugs and drug crimes? The main practical problems are the operational effect of the anti-drug policy and the current situation of the punishment treatment of drug offenders.The second part mainly explains the sample status and data processing methods.In this paper,329 data samples of first instance drug-related criminal judgments are excavated.By using the correlation coefficient analysis method and linear regression analysis method of spss statistical analysis,this paper compares the characteristics of different types of drug crimes in order to describe the current situation of drug offenders’ criminal treatment.Based on the results of the above data analysis,the third part puts forward effective countermeasures to against the drug and drug crimes.Realizing the change of drug control purpose concept from drug ban to drug control.Respecting the objective law of drugs in governance and developing substitute for economy to achieve the long-term and effective comprehensive control of drug crime.In judicial practice,drug classification system should be implemented and the legal punishment range of drug crimes should be refined as well as increase the breadth and depth of application of fine penalty.This paper provides data support for the theory of crime control to a large extentthrough empirical research on the sample of drug-related judgments.And the empirical research is divided into two directions.One is to examine the purpose of anti-drug policy.It is reflected by the indicators of drug crime cases,the number of criminals,the number of drugs seized and the number of drug addicts over the years.The other is to compare and analyze the linear relationship between the severity of penalties imposed by drug offenders and the number of drugs.Two countermeasures are put forward on this basis.One is theoretically change the purpose of drug control policy to eradicate drugs.The other is drugs should be classified in judicial practice.Then,we can refine the legal sentencing range of drug crimes according to the harmfulness and quantity of drugs.At the same time,the scope and depth of the application of fine penalty should be increased.
