Civil unmanned aerial vehicle（UAV）in recent years gradually entered people’s field of vision,showed an extremely rapid development speed and wide development prospects.The market trading volume is also growing at the rate of 10 billion yuan per year.While civilian UAV enriches people’s life,it also brings some problems,such as tort of civilian UAV.At present,the regulation on this issue is not comprehensive,and civil UAV tort liability research related theory system has not been perfected either.Under this background,it is necessary to study the tort liability of civil UAV.Start from the concept of clear civilian UAV,civil UAV refers to the aircraft controlled remotely by means of technical means and signal transmitting base stations.According to the operation risk,civil UAV are divided into micro UAV,light UAV,small UAV,medium UAV and large UAV.From the analysis on the characteristics of these civil UAV infringement,with some news,will be defining the civil UAV tort.In view of different types of civil UAV,different elements of tort liability,light UAV,small UAV infringement belongs to the general category of infringement,the infringement of medium UAV and large UAV belongs to the special infringement category.In particular,the principle of attribution applies to the presumption of fault liability for the infringement of light and small UAV,and non-fault liability for medium and large UAV.In addition,combined with the problems arising from the practice,points out that the current law regulation of civil UAV infringement problems.For example,the absence of privacy protection obligation,unclear determination of the subject of liability,and rigid application of different causes of exemption of liability.And put forward the corresponding suggestion pertinently,including some feasible auxiliary supporting measures,reference to the civil aviation aircraft black box,technology for civil UAV violations active record in a timely manner,control electronics enclosures reasonable limit civil UAV flight defined,alleviate civil UAV black fly infringe others privacy issues,subject to compulsory liability insurance system of ‘no fault insurance’mode to compensate the infringed timely.
