Assumed The Guardian’s Tort Liability

A study of the liability of the damages made by the person under guardianship needsfurther research in the field of tort law. It reflects the balance of legal interest on guardian,guardianship, victim.From the perspective of the basic theory of the person underguardianship who assumes the tort liability, an analysis of the nature of the responsibilitiesof the guardian needs to be done. We also need to understand the principle of culpability,the basis and the mode of which the person under guardianship assumes the liability. Thisdiscussion of this study will be from the perspective of Art.32of Tort Law, he imputationprinciples of guardianship in our country. Drawing from the relationship betweenparagraghs1and2, which outlines the components of the damage,and the rule of whoassume the remedy for the loss, some related issues about the responsibility of the guardianare systematically discussed. These include; he main body status of the guardianresponsibility,the improvement of the monitoring, the application of the equitable liability,the loss of the guardian’s responsibility, and the liability issues after parents’ divorce.
